Info Needed - Regarding H1 Extensions...

Hai,

I like to know some info about my H1 Extension.

Currently My H1 Will Expired on June 11 2006. But I filed my Labour Certification through the PERM Process on Oct 15th 2005. My Labour cleared on Jan 28th. I filed my I-140 on Feb 22 2006.

My Lawer told me If your I-140 Cleared, you will got, three years H1 Extension. I just want to know what if my I-140 didn't clear?

Is it possible still i can extend my H1 based on my cleared labour? If anyone came across this kind of situation, please share some info..

If I140 is not cleared, you have to rely on 365 days old LC to get H1 extended. As your LC will not reach 365 days when your H1 is expired, you can not get extension.
 
Has anybody done such H1B transfer pending I140 appeal with AAO

I have got my 8th H1B extension that is good from Apr. 2006 to Apr 2007.
If my I140 appeal goes to AAO due to Ability to Pay, I should be able to get my 9th H-1B this Oct.(within 6 months of my 8th H1B expiry) with my current emploer.

Did anybody know the following scenarios:
(1)Suppose I find a new employer around this Oct. and I also got my 9th H1B using premium processing later Oct.
When the new employer transfers my 8th H1B, can my approved 9th H1B also be transfered?
(2)Suppose I find a new employer before this Oct. and I can't apply my 9th H1B with the current employer due to 6 months limit, can the new employer apply my 9th H1B based on the pending I140 appeal with AAO?
If the new employer can do so, what evidence is required from the previous employer?
