Hi guys , I am a end of last July filer and my EB2 PD is current for June VB ,however, untill last week I found out my PD was wrong in USCIS system . I contacted my attorney and they denied at first, but they finally agreed when my company's specialist showed me the image of my I140 approval notice which has wrong PD on it.

Then my attorney placed expedite service request for correcting my PD and said it would take up to 5 days. But now it almost 10 days past ,nothing happend , and my attorney didn't response my email inquery yestoday.

So guys , if there any ways I can push through this,my attorney is not very corporative even I forgave their mistake on not verifying information on my I140 approval notice in early May...

hi, did you have labor substitution? If so, then your PD on 140 will not show the labor priority date, but the 140 received/approval date.

this is based on my original LC ,not a substitution.

but I am not sure how the error was generated in USCIS systems ,either USCIS data entry error or my attorney made some mistakes.

I'd be shocked if USCIS resolved it in 5 days. I'd wait 30 days.

hi TheRealCanadian , do you know any experience to push company attorney on resolving the issue with USCIS quickly?

I feel my company attorney is very passive ,they didn't verify the error for my PD when they received my I140 approval notice early last month ,and they continuely denied my inquiry about my PD printed on I140(they were lying) ,untill 2 weeks back they finally agreed that my PD is wrong and slowly took action on the issue... now I mainly depends on my company's HR specialist to stand up with me ...

TheRealCanadian , I have I485 pending at Texas center ,if
they didn't mess up my PD on I140 , I would say my case meet all conditions to be adjudicated this or next month.

My attorney lied to me on PD information since early May , do you think I have chance to sue them if finally the mistake jeopardize my family's timely immigration benefits ?

Unlikely. What tangible losses have you suffered? Can you prove that if the PD was set correctly (by USCIS) that you would have been approved this month?

Probably your best bet is to inform your employer of the attorney's conduct and perhaps they will seek other counsel.

TheRealCanadian , thanks for your comments , currently my company's specialist trying to push my attorney little bit...

Regarding potential loss , even I can't prove that I will otherwise be approved this month , while very likely ,but obvious their lie&mistake completely excluded me from the entitled timely opportunity by laws&regulations&rules. Also my family's overall life impact caused this shocking news.

Well, actually mine was amended to show the correct PD and it was done in one week, July of last year !

My attorney's liaison had contacted NSC on phone directly on this.

I guess you can get shocked now ;)
