Hi,

I am about to start the AOS process.

I think an important part of the process is that husby has to file affidavit of support. But I am not sure how the income requirements work, and I am afraid his income of 54K may not be enough. we have 6 kids: he has 3 and I have 3, and our combined incomes is about 100K.

whose income is considered during sponsorship, that of the sponsor alone or the entire family unit ? My job could sponsor me, but because of medical inadmissibility, I would have to be sponsored by husby...

Secondly, I have sole custody of my kids whose father does not live in this country -- we are all Canadian citizens. Do I need his clearance before the kids can immigrate to the US?

form I-864P, 125% of poverty line, husband's income alone is more than enough. Husband must be a sponsor, if he is the one sponsoring your immigration. Medical inadmissibility would be an obstacle in both employment and family immigration categories.

How are you earning right now? on your EAD? how is your employment history in the last few years? did you earn that money legally?

are you having some kind of work permit to work in the US, then it is sufficient. check with your lawyer. I had a similar problem but my sister-in-law helped us out in filing as a joint co-sponsor.

I am relieved that husbands income is above the guideline amount for our family size of 8.

Regarding my work/status.. I have been in US on TN-1 since 2003. Currently, I work as a college professor. How would this work permit help with the I_864 filling?

thanks very much...do you have any thoughts on when custody issues are involved -- i have full custody of our kids but my ex has access. do i need some form of prior approval from the ex?

your husband's income is sufficient, together it is more than enough. If I were you I would put both of our income in there, just in case. In my first interview my interviewer asked me if my wife was working [which she was not] and wanted the proof the last time she was working [that was like 3 years ago]. you never know. if you put both of yours the IO wont even bother you with the income details even though your family size is large. Again your husband's income is more than enough.
 
I am not familiar with Canadian custody regulations, so I can't tell you what you need and need not get.
 
An advantage of only using your husband's income would be that you can file the easier form I-864EZ, although it doesn't save you all that much paperwork. On I-864 you're allowed to include both your incomes as well as both your cash-equivalent assets.

In our case, we opted for I-864EZ with my wife's income only.

Has anyone had experience with their petitioner changing jobs or perhaps stopping to work while the intending immigrant becomes the main source of income for the family ... does the I-864 have to be updated if the intending immigrant's income was not included in the first place but circumstances have changed as described later (after the AOS)? I only see a reporting requirement for a change of address (I-865) but nothing about a change in income situation.
