Immigration Question Help!

Hello everyone.

Okay well I am so happy to find this website and I just want to get right to it!

Well let's say if a family came here in 1996, a mother, a father, and a 4 year old child on a i-94 B2 Visa.

They did NOT INTEND on staying in the United States but a child that was supposed to be born 3 months after the united states visit was born PRE-MATURELY in America. They overstayed their visit by a LONG shot but still...

They have been in America since then and did come from Asia as an inspected family ( hence the visa ) and have done NOTHING wrong at all.

Would this make a good case since the baby was born prematurely and going back to Asia with a very sick child is obviously a horrible idea since the young child needed doctor's support 24/7 for long periods of time.

They did not come here illegally like some of the Mexicans and South Americans do.

ANY help would be greatly appreciated in whatever way possible!
 
There is nothing they can do to remain in the US as legal residents at this time. A US citizen child cannot provide any benefit to a parent or sibling until age 21. Any the illegal stay of the sibling will not be forgiven by the petition of a US citizen.

Yes, they have done something wrong. They did not return home once it was possible for the child to travel. They are ILLEGALLY PRESENT in the US; they have now overstayed so long that they have a 10 year bar to reentry once they leave.

There is little difference between an EWI and overstay; both are violations of US law.
