I'm so confused with this process, please advise!!!

Hi

I just got my unconditional green card. At the present time I'm married to a US citizen(since Dec'06) and I've had my green card since Nov '07. I've been told that I have to wait until August of this year (90 days after my 3 years as resident) to apply for the citizenship, but I've also been told that I can't apply now.


What's the thruth behind all this??

Please help me, I'm very confused :(
 
It might help if you elaborated on the rationales you heard.

What is the "Resident Since" date on your unconditional green card? It will be clear to get all dates known. You are mixing up some dates I believe. Similarly it is not 90 days after 3 years as resident, it is 90 days before 3 years as resident.

Could you reconfirm the facts and rationales, and hopefully in chronological order?
 
With the limited information you provide it would seem that you could apply around August this year, 90 days (better count 85 days) before your 3 year of permanent resident. I am basing this that as you married on Dec 06 you have been already married to a US citizen for more than 3 years, so you already qualify on that front and just need to wait until you qualify for the continuous resident requirement that is what I covered above (3 year of GC minus 90 days, 85 days to be safe on calculation errors).
 
I agree - you can apply in August. Though it is 90 days before your 3 year PR anniversary, I (and everyone else on this forum) suggest waiting a few extra days to avoid being rejected for applying too early, because USCIS makes mistakes sometimes).

You can apply up to 90 days before you have 3 years of continuous residency as a LPR and married 3 years to USC.
 
Here are my dates:

Dec 27 '06 - Got married.
Nov 19 '07 - Date on my green card as PR.
Feb 25 '10 - Unconditional green card approved.
Mar 3 '10- 10 years UGC received.

I would not recommend signing, dating, or mailing the application before that. The 90 days would put you on August 21st. Again, if you sign, date, or mail your application on August 21st you increase your risk of having USCIS create some trouble around the calculation.
