Please help , I am in very difficult situation
I am a permanent resident and i will apply for naturalization next month . I just found out that even if I will be US citizen I can not do anything to fix my husband's immigration status .
Here is his case:- he is from Mexico
1999- He came in USA with visitor visa, he stayed and worked almost 2 years
2000- He went back to Mexico to visit his family and when he attempted to return to USA ,at the border they took his visa and he was fingerprinted( they found a proof that he was working)
2003 - He attempted to pass the border without inspection and he was caught and fingerprinted again.
2003- He succeeded to pass the border without inspection
We got married in 2006 and we have a 2 years old daughter . He is a very good husband and father , is working , filling tax every year.
We don't know what to do ,we hoped that we can fix his status if I will get my citizenship. An immigration agent told us that is nothing that we can do, so please , help, thank you
 
Since he entered without inspection he can't adjust his status. You should get a good attorney, file a I-130 and when its approved he can go abroad to get the immigrant visa at a consulate. He might be subject to a 10 year bar, so talk to an attorney first.
 
he screwed up big time when he left the country and got caught coming back...

Depends whether USCIS knows he is here. He should be banned for sure. Whether he will be is a different question. You need a good attorney and you might have a shot at fixing this.
 
yepp get a good attorney to fight for you guys. He normally would get banned for 10 years then he can re-apply but theres been times when people fought it. Good Luck. Both my parents got the 10 year ban because of something my dad did 20 years prior.
 
I don't know where you live, but there is a great attorney in Texas called Laurel Scott, he is known all throughout the US in waiver cases. And she has free chats on her website on Wednesdays. Maybe you should try one of those and to see if your condition is that hopeless.
 
One of the conditions of being eligible for adj. of status is that you entered the country legally. He did not. Get a lawyer.
