I94 Revalidation for H4 EAD Auto Extension

Hello Sir,

Looking for some advise/Opinions on below queries related to I94 Revalidation:

Current Scenario -
1) I am currently working on H4 EAD.
2) H4 Visa and EAD both are expiring on Jan'2025
3) My Stamped H4 Visa on Passport is also expiring on Jan'2025
4) Applied for extension in Oct'2024 and currently in Pending status.
5) My Spouse H1B recently approved until 2027.

Queries:
Based on the current waiting time, i am not expecting my approval by Jan'2025 and I am thinking to go to Mexico for I94 Revalidation to extend my I94 based on approved spouse H1B (I797 approval notice).
1) Am i eligible for I94 automatic re-validation, since I have valid stamped Visa until Jan'2025? and one of the eligibility criteria for revalidation is to have expired stamped Visa.
2) If I travel outside US (To Mexico), will it impact my pending H4 and EAD applications? Do I need to reapply both the applications?

You can leave and re-enter on the basis of your valid H4 visa, and present your spouse's latest H1b I-94, to be admitted until the same date on your I-94. This isn't Automatic Revalidation, but a regular entry. Your H4 Extension of Stay application will be automatically abandoned when you leave the US (since it no longer matters if it is approved or denied). Your EAD application should not be affected, and once you re-enter, you should be able to work on automatic extension of work authorization for pending H4 EAD reneal with a valid I-94.

In the same situation. I 94 will expire soon. Ankit- appreciate if can share your experience. Did you travel to Mexico to revalidate I 94? If so, which location you been to? It would be very helpful if you could share that!
 
Hi there, I am in exactly the same situation. My wife's H4 expiring in Mar 12th. I received my I-797 more than a month ago on premium. Unfortunately, the H4 is still pending.
Is going to Mexico a valid option for my wife and come back before her current Visa expires and get her I-94 revalidated to 2028? How has been the experience for the folks who had recently tried this option. Are CBP oficers going to do that or should we ask them specifically to update our I-94?

We tried recently went to Cancun Mexico and came back to Atlanta GA PORT OF ENTRY its smooth no head ache

U should have valid I-94 with visa stamp so you can travel to Mexico and come back with new I-94 ask them to update based on new I94 of H1B
 
Thank you for the quick reply. Planning to just go and come back the same day. I am in West Coast. So, thinking of the closest place - possibly Tijuana
 
hi I am in same situation. I want to travel to Mexico Cancun as well. I m just unsure what reason shall I state to the officer while coming back at Port of entry. shall I state the correct reason. would it be fine @sanjeev_27 please advice
 
@niti2025, I would give the same reason. I dont think there is anything wrong in giving that reason. We are planning to go to San Diego and drive to Tijuana just for this reason and want to give exactly that reason
 
@satheeshka my EAD is expiring in may 2025. Husband’s h1b got approved until 2028 but my h4 is still pending. Planning to go Cancun. Visa stamp expired in 2021 but h4 is valid until may 2025. Can I go to Cancun and re enter and ask them to update h4 i94 until h1b approval date. Pls reply.
 
I dont think you can travel outside US and come back without VISA re stamping. You will have to get your Visa stamped before re entry. the I-94 re validation is possible only if you can legally re enter United States which in your case not possible unless you gEt your VISA stamped at US Consulate outside US

As long as your current i94 not expired, you can travel Mexico and come back auto revalidated based on spouse approval notice. though visa stamp expired. But the caveat is if you have applied for visa stamping and then traveling Mexico, you cannot get it extended.

@satheeshka - Did you get your I94 extended? What did we say to the CBP officer? What documents we should carry? I would appreciate any help.

We are in the same boat and planning to go to Canada for the I94 extension.

@Astroph - did you get your i94 extended by travelling to Mexico? Can you please provide details on the same. I am in same situation. It would be of great help. Thank you
 
Hi,
we are consider submit H1B, H4 and ead extension recently. My wife's H4 and ead card will expire on same date 9/6/2025, if She submit the H4 and ead extension right now, but still in processing after 9/6/2025, Can she still work? She use H1B visa to enter U.S and change to H4 in last year. Her H1B I-94 admit unit date is 4/06/2026.
 
My spouse previous H4 expired, but we have H4 EAD auto approval notice + H4 extention is in progress. Is it possible without crossing the border extend i-94 expiration date?
