I94 Query..

Mine, and my wife's visa were valid till Feb 2006 but our I94 is valid till Feb 2007 based on the new I797 we showed at time of entry. Now I switched jobs, and she changed status from H4 TO H1.

Both of us should be getting new approved 797 forms with attached I-94. The I-94 that we'll get with the new 797, will that suffice or are we supposed to send our passport somewhere to get new I-94(white ones)?

Are you trying to correct I-94 ?
If you got new I-94 with H1/H4 approval, that should dictate your status from the start date.

No, I am not trying to correct it. I am trying to understand if I need to do anything at all? I am trying to see if the I94 attached with the H1 approval(validity till Feb 2009) will suffice once my current I94 expires in Feb 2007..

Following the thread of events: I have not received my new I797 approval for my h1 transfer. So here are the details:
current passport has I-94 valid till Feb 2007
My new I797 approval from last company valid till Feb 2009
New 797 approval from new employer not arrived yet? So if this approval does not arrive till Feb2007 will I still be in status??

My wife's situation:
She received her H1 approval (797 approval notice), so I assume she will be ok since she has the new i-94 from her 797.

Generally speaking, if the I-94 attached to your passport has expired when you leave the country, doesn't that cause a problem(even though you have a newer approved 797/I-94)??

(even though you have a newer approved 797/I-94)??
-----------if you have new approved 797/I-94, why the problem?? if your I-94 is expired and you filed H1 extension or transfer before expiry of your I-94 and the H1 petition is pending you are in status.
