I94 and EAD

If your I-485 is pending, you are authorized to stay in the US until it is ajudicated.

My H1B expires on 13-FEB-04. Attorney will be sending my Documents of I-140 and I-485(Concurrent filing),EAD,AP by next weekend to BICS for sure.
1. When can I get my EAD and AP since my H1B is expiring on 13-FEB-04
2. What are the ways I need to be legal after my H1B expiry?
I travel to Europe very often on Job

My H1B expires on 13-FEB-04. Attorney will be sending my Documents of I-140 and I-485 (Concurrent filing), EAD, AP by next weekend to BICS for sure.
1. When can I get my EAD and AP since my H1B is expiring on 13-FEB-04
------- it depends on your service center; I think that you will have less than 6 months H1 validity after filing I-140, I-485 EAD AP. You may get EAD, AP but the risk is that many are getting RFE for I-140 for education evaluations or employers more financial documents. Nobody can give you a date when you will get EAD, AP.
2. What are the ways I need to be legal after my H1B expiry?
-------- If I am in your situation I will immediately sent my H1 extension papers so that I have valid H1 after 13-FEB-04 because for H1 extension also they are taking 4-6 months time. I will not take the risk because all the service center may not touch I-140 till 31 October because of religious worker I-485 approvals BCIS have dead line to complete these cases. If completing 6 years then file for 7th year H1 extension the day you get I-140, I-485 filing receipts
