DO YOU REALLY NEED AN ATTORNEY FOR FILING I-539 ?(EXTEND/CHANGE DEPENDENT STATUS - H4 )

CAN I DO THIS MYSELF FOR EXTENDING WIFE'S H4 AND FILE WITH ALL THE DOCUMENTS AND FEES TO APPROPRIATE SERVICE CENTER ?

THANKS

Yes.
There is a Do it Yourself link in one of the immigration sites you can try. Some have filed I539 on their own too.

i did it myself

hi roy,

I filed for my h1->h4 change of status on 1st april. got my recpt notice on 17th april and today i called up to check up my status, to my pleasant surprise it was already approved ... so, i think u dont need an attorney to file a i539.

good luck

Can you tell me the documents submitted with i-539 petition and also the fees ?

Appreciate the help!

pretty simple

539 to change status from h1 to h4

1) filled in 539 form(carefully fill in details of your address, i had some sleepless nights about that thinking it maybe lost in mail or gone to a wrong address.. :)
2) photocopy of my latest i94(front&back)
3) photocopy of my h1 approval(front&back)
4) photocopy of my p.p(the 1st and last pages and visa stamp)
5) photocopy of my last 2 paystubs

6) photocopy of my husbands h1 approval(front&back)
7) photocopy of his p.p
8) photocopy of his 3 paystubs
9) photocopy of our marriage certificate
10) fees of 140$ as money order(but some say pay as a personal check, becos the personal check has a stamp of the EAC#, just in case if the recpt notice is misplaced, u can track with that #)

pretty simple...

Thanks a lot for the info.

1 last question, do you need to send the I 129 Petition for the prsent H1 holder ?

is this 539 for a change of status from h1 to h4 OR an extension of a h4 status...? for either of them u dont need a 129 petition. U need to show the primary person's H1 approval(i guess it is the husband) and supporting documents of his (like recent paystubs)to show he is in status and can support the applicant as a dependant.
