I485 Pending-Out Of Status (need help )

Hi ,

Can u please advise me on my case.My PD is dec2004 and I485 ND is sep20th 2007.My I485 is still pending.I left USA in feb 25th 2008 because my parents not feeling well and still i am in india for another 4 months.Can i come back to US in jan 2009 means almost after 1 yr .I have valid H1 valid till sep2010.
My AP is valid till Nov2008.Just wanted to know my I485/H1 will still valid or not?i DONT HAVE ANY PROBLEMS WITH MY EMPLOYER ALSO.He said u come any time and join.

You had AP. Technically you didn't abandon your AOS but there is a good chance they will ask you questions about your long absence.

--------------------Yes if you have job in US and valid visa stamp(keep the letter with you when you come and show only if asked)
