I'm in the process of filing my I485. And my H1 is valid until early 2005. And hence I'm not filing for my AP, EAD. My attorney said that I need the receipt of I485 filing if I need to travel abroad? Is this true? Why can't I travel with my valid H1B visa?
You CAN travel with valid H1B visa stamp. Just keep the copy of your I-94(front and back) for your future records as you have to surrender I-94 at airline counter. You need to be in US the day your I-485 is received by BCIS I suspect that your lawyer has not filed I-485 with BCIS till date that is the reason he gives you wrong advice. also keep the boarding pass with you as evidence that you departed US after filling I-485. ask the lawyer for fedex reciept of I-485 filling.
