I140 RFE, EAD & AP still on hold....

I filed in 12/2003, and my EAD, AP are still on hold. The worst part is THERE IS NO RFE. Sent fax inquiry, no update. Damn them..

You're right, it's weird, and the attorney told me that this is the first time they received a RFE for I140. The hospital that I'm working at has way more than 100 employees, I would say including all staffs with different work status, it may be close to 1000. It is a pretty big regional hospital. I think they replied the RFE with a finanacial statement certified by the CFO. And I think there were several employees' applications submitted at the same as I did.
By the way, anyone knows what is "Liasion assistance"? My attorney stated they are going to seek help from liasion assistance.....

I remembered you told me filing a H1B is another option, is that true? My attorney seems not quite agree with me...

I suggested my employer to extend my TN and then file H1B. My director agrees with me but it is HR who makes the final decision based my attorney's advice. So I don't think they will file it for me.....sucks....

I'm in a similar situation to chongyip case. My I-140 RD 02/05/2004, Me and my wife I-485, I-765 and I-131 RD is 03/05/2004. I received I-140 RFE on 03/15/2004. My first finger print done on 06/07/2004. I-140 RFE received by USCIS on 06/08/2004. It updated online. I went to local office to collect EAD after 120 days. They said me and my wife I-765 and I-131 are on HOLD. They told me to contact NSC. I contacted NSC they said my case is on HOLD because it is waiting for I-140 Approval.

Please share your information with me. It will be really helpful for me. My wife got a good job. If we don't show them EAD by end of this month she will not get the job.
 
I haven't heard back from my attorney although I emailed her already to ask for update....that's why I didn't update my case.....I only have 2.5 weeks left on my TN, I'm prepared to take unpaid leave. I can't think of any other ways to continue to work legally. My director is still pursuing HR to file TN extension, but I guess HR is waiting for the attorney's reply.

My I-140 RFE was also ability to pay from employer and his latest tax returns. When we filed I-140 it was in Feb 2004. 2003 returns was not filed. But USCIS asked for 2003 tax returns.

My Education background is Bachelor degree in Science( From India) and I have 10 years of experience in IT field. My attorney sumitted Education Evaluation report when I applied for Labour. It approved with out any problem. I had 3 years H-1 visa it expired after 3years I joined another company I have H-1 till March 2006. But I appiled GC through another employer as a future employ.You are really good advisor. What do you think about my case.

Talking back about RFE on ability to pay, I don't understand why USCIS picked my case specifically. The hospital that I'm working at has been sponsoring GC for a long time and during the same period of time they submitted applications for about 10 more staffs, none of them got picked except for me. Can you think of a reason?

Hey UN,
Do you think I can sue the lawyer of being "negligence" or "malpratice"? In healthcare field, workers always get sued due to negligence. To me, my attorney is negligence because she doesn't even know we cannot apply for iEAD if I140 is on hold. She takes it for granted that if I don't get EAD on time I'll be able to get iEAD. I'm so angry because I'm forced to take no paid leave....who's responsible for my finanacial lost during this time?

I haven't heard back from the attorney, she's avoiding me, I'll call her office tomorrow....
If I didn't ask, the lawyer didn't even let me know about the RFE. At that time I was wondering why all my co-workers got approved for EAD and AP but not me, I keep asking her again and again then eventually she stated it "might" be because of I140 RFE but shouldn't be because RFE is not for EAD and AP. She doesn't even know I140 RFE will affect all other applications. I guess the hospital replied the RFE with CEO signed letter because the CFO left. According to them, USCIS didn't accept that letter and requested another one. The hospital had to get the Controller to sign another letter, but she was on vacation at that time.....these all slowed down the replying process.
 
What is case status referral? Is it the same as status enquiry? If yes, we've done it already but no reply yet.
Most of the staffs applying for GC are Canadian, but I know one staff who is Indian and she is on H1B. Does it make a difference?
Hey, can you teach me how to persuade my employer to file TN extension? I have to be able to provide firm reason that it is feasible....

I called attorney again today, she forwarded me an email reply from CSC saying that "your case is with an Adjudicating Officer in line for adjudication. Please allow sufficient time for processing." It really doesn't say anything constructive but as the lawyer said it is at least a response. It was replied by a "CAO" in CSC.
In your opinion, is that a good response? or nothing special? If I have to wait in line until the adjudicate it, it may be the end of this year or even next year! I'm under Schedule A occuptation and CSC is only processing May/June 2003 application. I cannot wait indefinitely for them to adjudicate my case!!!

Recently my wife got residency in one of the hospital management. Hospital management given a letter asking USCIS director to process my wife case faster . They also mentioned my wife haven't received EAD, Delay getting her EAD, she can't start with other residents students. It will impact on hospital patients because they have to change the schedules to other residents till wife get her EAD. Hopefully if they consider my case, I might get the results soon.

Good news! My AP got approved today!!!!! "Last update" time for I140 and I485 changed to today, however, EAD is still the same - last update in Feb. UN, does it mean that they lifted my I140? Will I be expecting EAD soon?

BTW UN, do you think CSC is treating my case under the pilot program? They updated both my I140/485 together (although the content of the update doesn't change)....Thanks!
 
I don't know which EB category I fall under. I'm under Schedule A occupation. I think it is a subcategory of EB 2 or 3.
I had my FP done in April. Hope they're treating it con-currently!
