I140 Education equivalency

I've got an evaluation that states BA CS equivalent.

My labour (Section 14) states
College: 4
Degree Required: Bachelor's degree
Major Field of Study: CS or equivalent

Does anyone see any problems or have any thoughts about this?

I am appealing an I140 denial.

My I140 (EB3/RIR approved) was denied citing that "Without a letter from a person who has the authority to grant college level credit stating that my Computer Course is equivalent to 1 year of college credit, the certificates cannot be given evidentiary value."
 
Which computer Course have you done along with your BA or is it a 3 year degree course + experience evaluation ? Pl specify.
 
I have a BSc. in Physics (CS Applied component) and 1 yr Aptech and other courses and certifications.

No experience should be considered in the I140

Since EB3 requires atleast a Bachelors All I want to know is whether a BA CS equivalency will do? I think it should but any feedback is appreciated.

You have strong case if your labor states that bachelors degree or equivalent.

Hi Guys,

In my labor it was mentioned BS in CS or Work Equivalent.
I have 3 Yrs degree + 2 Yrs NIIT diploma & 7 Yrs of experience.
Please let me know if there are any previous I-140 approvals for similar cases.

Have your lawyer check the certififying entity. The entity you got the evaluation done might not be reconized by BCIS. " Without a letter from a person who has the authority to grant "

I have another question.

The original evaluation I sent in equates my qualifications to a BS IT.

Now I have a letter from a "person who has the authority to grant college level credit" but it states BA CS and another new eval that states BS CIS.

In either case all evals states Bachelors and both are CS equivalent. Diff. companies have evaluated me has having different degrees.

I've been told that if I appeal with a different evaluation. Both the original and the new evaluation will be tossed out and the appeal will be denied?

Does anyone have any thoughts on this?

What do I do? :(

I received an RFE regarding the Ed Eval. I have a 3 years degree. I got a letter stating that I got a Professional training for 2 years and they are equating this 2 years to 1 year of study. I am yet to file my RFE.

I heard that there are couple of good companies for Ed. evaluation in US and also their evals is respected by BCIS.

I did get an RFE and I got an evaluation done stating BS IT. But then the denial from BCIS.
My situation seems to be new, But dont make the mistake I made get an expert opinion letter (from a person who has the...).

Try www.fis-web.com. They are very reputed and seem to be the only Evaluators offer this new service that BCIS seems to want.

freddy_ace, the website that you have provided doesn't seem to work.

My attorney told me that they are getting the Ed. Eval from a very reputed company and they think that BCIS has never questioned the credentials of this evaluator. I'll have to wait and see. Will be filing my reply to the RFE this week.

1 year diploma in Computer Prog + 6 month diploma in IC design + 4 year of work experience

Do I qualify for four year eq on this background ?
I want to apply for H1 for IC Design position.

I'm sorry GC_mission, I'm not the best person to give you advise. I know that getting an H1 is getting difficult these days too. It all depends on the company applying and whether they think you are suitable for the job and then your Credential Evaluation reflecting the equivalency that the company is asking for.

requirement on it is BS(comp sci), Electrical
Engineering or related field. My degree is 4yr
BE(Mechanical engineering), so it should fall in
related field. Will I get RFE based on this in I-140
stage.

The title in newspaper ad is Sr QA Specialist,my job
title is System Analyst. My job functions, roles,
responsibilties and years of experience all match. DO
you think there might be a problem because of
different title. The title given within our company
is generic. Will I get RFE for this.

Substitute Labour says Bachelors Field: Computer Science, Electrical Engineering or related field. Right?
Has your lawyer told you that you Mech Eng falls under "related fields". Ask him!
There have been people who've got their GC with Mech Eng and they are actually Comp. Programmers.
There have also been cases where Mech Eng is not considered related to computers and have been denied.
Whether you get an RFE or not all depends on the CIS officer.

My lawyer thinks it would fall in related field. Most educational RFE problems I read on this msg board are when people have 3yr degree vs 4yr degree.
The reason I am worried is becasue my 6 yr term is ending in Feb2004, if 140 gets turned down then I will have to leave country. Just wanted to get idea of what people in msg board feel, based what their experiences.

I don't think you would get an education related RFE since your degree clearly is a related field. Even if you get a query regarding the job title you can always highlight the areas of job functions and roles with the previous experiences against what is mention in the labor and you will be fine.

This is just my opinion, still refer to all the legal help.

Even three year degree holders can get I-140 approved.
My friend, a B.Com(merce) holder just got his approved after
RFE. Another one, B.Sc physics got his approved without
RFE in just 3 months. OTOH, I've seen BCIS sending RFE to
people who have MS from US.
