Hi,
My I140 is approved. Appiled for EAD and AP which I should be getting within 2weeks per my lawyer. I485 is pending.

Here is the question:
I'm engaged and my fiancee is in India. I want to go to india and marry her. I want to bring her along with me. Can I get H1B for 7th year and bring her on H4? if not, what is the best possible scenario?

Thanks
Krishna

The only options you have are:
1. You get H1 7th Year, and then get your wife on H4

2. Your wife applies for F1 or H1 or another kind of Visa and comes to US, you than marry her here in US and add her to you 485. However, if she comes on a non-immigrant intent visa like (B1-B2) you won't be able to file her 485 right away, you will need to wait for 3-4 months or something like that. Ask a lawyer.

3. You wait till your 485 gets approved and then file Follow To Join for her. FTJ will take around 8-9 months after you file it.

So the best option you have is get H1 7th year.

Thank you Gujju.

Is it true that once your H1-B 6th year expires and your I140 is approved you cannot apply for 7th year?

whom to complaint to ..????

Here is a very pitiful situation .. of one of my buddies ..
His father was supposed to come to USA last month , every thing worked out well , till his father board the flight and reached the port of entry .
At the port of entry , the officers discovered that the page of his VISa Stamp was not there .
My friend's father was ill-treated , interrogated , misbehaved with , and immediately deported back to India .
He visited USA couple of times in the past , and has a 10 yr M .Entry Visa .

HIS VISA PAGE WAS STOLEN IN INDIAN INT'L AIRPORT (Chennai) .
HOW PAINFULL AND SHABBY IT IS .....!!!

Now my buddy is so broken and dishearten .. and does not want to even share this with any one .
But I am stepping up for him , to know what needs to be done ? Whom to approach for the injustice done to that respectable senior citizen of INDIA ....

Any help or guidance is GREATELY appreciated !!!!!

-------- 7th year H1 extension should be filed before H1B or your I-94 expires, If you have valid I-94 and I-140 filed then attach I-140 filing receipt with 7th year H1 extension before your H1 or I-94 gets expire

------ That is what they were supposed to do, because he did not have Visa for US. How did he board the flight from India to USA with out US Visa?

---------- He should report it to police that his Visa page was stolen at International airport from his passport, he should describe the situation in detail to police and should get the police report copy and should go to Chennai US consulate and inform then with report so that other person cannot enter with that Visa the consulate will guide what to do and if he can apply for new visitor visa he should go to consulate and must inform them they have the record of his Visa and if he has any copy of that Visa page he should take that also. I am ashamed to read this that this is happening in India. At the airline counter they check Visa and then at the immigration counter before departure they check the passport and Visa stamp I hope this happened when he crossed the immigration, customs and was waiting to board the flight and he might have given the passport to somebody to have a look and…… this should also be reported to the particular Airport in India where it happened because it shows that such activates are happening inside the airport. You must post this in other thread as new post in Hvisa related thread so that others can give you some info. You should also talk to lawyer in US and ask what should be done for future visa in this scenario
