I140 and 485 Premium Processing!

Does any one knows when is INS starting Premium Processing for 140 and 485?
Please let me know if is there any URLs related to this topic.

Rumor is sometime this spring

Some attorneys are saying May but there is nothing official yet. Nothing has been said about the I-485, May would be for the I-140 and nothing has been said about processing times either.

Mid-April is 6 weeks away

I haven\'t seen any official posting but in any case, there is currently NO premium processing for ANY stage of the GC process. I\'ll believe it when I see it.

I - 140 Premium Process

Does any body have any official confimation from INS
regarding I - 140 Premium Processing.

Dear Mr. Khanna

I came USA as a student in 1998, and then I was
studying until 2000. I had a serious economical
problem by the year of 2000 then I applied for Asylum,
they denied my application and told me to stay in My
F1 status because by that time I had my student status
well. Then I applied again to Immigration court and my
lawyer told them that I don’t want to stay in my
status I want to apply for next, then we did that and
we already have a appointment with Immigrations Judge,
my concern is for my school I am still in good student
status because I am full time student there we just
lie to immigration because I wanted to go to in front
of Judge. If I loose my case this time is there any
way I can still go back to my status or not? Or what
is the best advise you can give to me.
Actually I am from Nepal and their and my country has
a big problem going on in this time. That’s the
reasons I cannot go back to my country. Help me
because I think your origin is also India. If you help
me I can refer people to your place because here now
in New York there is big Nepalese community now and
you are not that much far from here.

Can I file I140 and I485 at the same time?

I talked to two immigration lawyers about EB1,2,3. One lawyer told me I could file both I140 and I485 at the same time, he said I could change my job for EB2 (outstanding researcher) after filing under current INS regulations. The other one said no. Does anyone have experience or know this. Please let me know at jzhang@salud.unm.edu. I appreciate it.

Is there a premium processing for I-485, if so, how much does it cost.? and how fast is the process
 
Filing 485, but getting laid off

Filed I-485 in first week of April 2002.
Layoff is scheduled in July 2002.
Already filed for EAD for myself(april) and my spouse(mar 27).

What are the possibilites available to me?
Can i find a similar job and be okay?
Does my green card stop when i get layed off in july?
Are there any loopholes that i can take advantage of?

The answer to this depends on how you read AC21. Normally, I take a conservative opinion on AC21 and I would say there is a serios potential for problems. However, you have no choice and you must take an aggressive approach to AC21.

My intepretation of AC21 in your case, or at least how it needs to be argued with INS if necessary, is that you and the company had the requird intent when the I-485 was filed and you obtain portability after the case has been pending and remains unadjudicated for 180 days. Once you reach that point (October 2002) you should be ok. You can work for any employer on your EAD but you need a permanent, full time, similar position for the GC to be properly issued.

In your situation my normally conservative position provides an untenable result so you, and your attorney must take an aggressive position with AC21 and hope that the final regulations are not antithetic to this position.

Moving to other country

Hello,
I have filed for I-485 in April 2002, and might be layed off in July 2002. Our company has branches in Brazil,Chile, Malaysia,Switzerland.
Can i get transferred to other countries with the same company and have my green card processing continue?

485 filing

April first week:
I gave the papers to lawyers to file for I-485.
April second week the company decided to close the Miami office.

The lawyers might have filed or might not have filed.

I got an offer in Atlanta for the same company and same position, but might start in may/june or july with that branch.

Lawyers are now saying that they are not going to file 485, and they have to restart the whole green card procedure when i move to atlanta in July.

Is it true what the lawyers say.? IS theere any way i can convince the lawyres to file my case? Is there a way to hire my own lawyers and file 485?

Please advise..
