I140/485 Concurrent filing

Hi there,

My LCA has been certified. I need information about the other processes. I hear that there are currently no visa numbers available and I don't know what to do about that. It probably means that I cannot do concurrent filing?

Also, I filed LCA as a skilled worker but I also have an MBA. Can I choose the option for professional worker with advance degree on I-140 or do I have to choose the skilled worker group.

I think you are confused. LCA is different from LC. Only LC can be certified. LCA is labor Condition Application for temporaroty job prevailing wage like H1.

You can only apply I 140 for the job certified in the LC. You can not change anything now depends on your degree.

What happens if a person files a concurrent I-140 & I-485 & I-765 & I-693 and then the I-140 is denied?

How exactly the process works?


What happens to I-765 in the mean time?

- Is it being approved before the I-140 is approved?

Or

- Is it being held for the I-140 approval? (To be denied if the I-140 is denied or approved if the I-140 is approved.)

EAD/AP get approved independently of I-140 - the whole purpose for EAD/AP is to give you GC benefits while you wait.

Once I-140 gets rejected - EAD/AP is invalid too.
Hope that says it all.

Well, this is clear. So if an individual applies for a SS number based on EAD and if the I-140 gets a denial - the SS number stays. Interesting. Right?

Yes, SS stays - just it doesn't entitle you to work.

Well ... it is just a teory.

I assume the SS you get is without any note of USCIS authorization.
If a person is not "entitled to" work after invoking the EAD - the appropriate information is not beign sent to SSA. This means noone will ever learn such person is not supposed to work.

If an employer calls to verify the status of such individual - he gets a clean answer from SSA. This is where he stops. There is no need to proceed further. You are only required to keep an I-9 for 3 years from the employement start date. That's it!

Am I wrong?
 
Unfortunately, my employer has blocked yahoo mails. I only have access to yahoo chat. So I cannot check my yahoo mail from work. But you can send me a mail on here and I will respond.

Applying parallel I140 & I485

I received LC for my EB3/ RIR. I dont have much knowledge of the rest of the process. Need help to understand. Can I for file parallel processing, Is it dependent upon visa availability. My country of birth is not retrogessed, does it matter for applying for parallel processing. etc.
