I130 rejection and filing of H1

Hi,

I am being told that there are chances of my I130 petition being declared void because of a change in my marital status. All the more because, my mother filed I130 for me while she was a permanent resident of the USA. She is still awaiting Citizenship.


Now that these can be grounds for rejection of my petition, i would like to know whether i can apply for a H1 along side. Will a rejected I130 have any consequences on my H1?

I 130 does not have any influence on your H1, you can apply H1 with no problem. Again I 130 is not going to give any status in US, it is a underlying immigrant petition just establish your eligibility.

Even I 130 got approved, you have to wait several years depends upon your country of origin before you get your green card.

Once your mother gets citizenship, you can amend your I 130 to Family based IIIrd category. Current priority date for world wide is 15 Nov 1998. If you are from Philipines, you may have to wait 15 - 20 years before you get your green card.
