I130 for spouse - affidavit of support and procedure questions

Hello,

Filed I130 for spouse and kid in Nov2010.
I130 approval email received on April 28,2011
NVC packet received on May15,2011 - which has the following:
  • Affidavit of Support - Processing Fee Bill Invoice - which I've now paid online
  • Choice of Address and Agent form - DS3032
  • Information about the DS-3032
  • Visa Information

Questions, I have:
1. My understanding is that the next step is for me to fill out and send the Affidavit of Support and attach recent tax submission or W-2. OR Do I need to pay the IV application fee ?
2. The Information about DS-3032 says that - "when there is an immediate visa available or likely within the next 9 months, NVC will send a letter enclosing the Choice of Agent and Address form to all applicants with a few exceptions". Since our priority date is Nov.2010 - how can I expect a visa to be available in the next 9 months ?

Hi, Once you pay the AOS fee Which i guess is around $88.00, and you send then the AOS documents, then you will be able to see the option to pay the IV fee, on the NVC web page, mean while send the Choise of agent form to your family and ask then to choose you as an agent and they can scan the document and send it to NVC. It would be much faster.
Once you pay the IV fee you family has to send in the filled out DC3032 form to NVC. along with all the supporting documents.

Question no. 1:

First you pay AOS Processing fee online or choose of alternative bill and send payment by mail. (but Online is much much faster). it takes 2/3 days to see payment status as "Paid" once you your status on payment said Paid, then, you will see the "Option" print the Cover letter. YOU MUST NEED this COVER Letter with barcode in order to process fast. Send AOS form and all other supporting documents such as W-2, job letter, IRS tax return etc.

Question No.2:

Your beneficiary need to contact by email or by phone or mail in order to request to Choice of Agent or Address form DS-3032 initiated on behalf. Call them and provide your and your primary beneficiary email address on NVC system. Once they have your email address, they start sending everything on email. Once they have email addresses in there record, tell your beneficiary to email requesting DS-3032 by email. They will send it within few days. Once you have DS-3032, you can print it, appoint the agent and sign it with dated and SCAN it and send it to NVC by email. nvcinquiry@state.gov. Once they have Choice of Agent on record, they will start sending you a IV Bill Invoice, once you paid online. it will be like question no. 1 process... sending form, civil document etc with Cover letter.

Another quick question: what if someone does not have income for one of the three years that has to be reported on the Affidavit of Support form. So there is income for 2010 but none for 2009 ?

According to the I-864 instructions page 8, the first sentence in the first paragraph of #25 only asks for the most recent year's tax transcript and specifically limits any additional to only 3 years.

UNLESS, you need more than the required minimum evidence to meet the 125% poverty level, don't send more evidence than what is actually required.
