a friend of mine has his I130 through his brother was approved. I have some questions, please help:
1. he wants to get married before applying for I485, would that affect his case (i.e. does he need to be single until he gets the green card?
2.his fiancee is outside of USA, what would be the best thing to do to ensure her coming here and adjust of status with him? can she get a visa as a fiancee based on the I130 approval? if they can get married on paper, would that help?

please help

thanks a lot

siblings of the US citizens do not need to be single. His wife would get a derivative status. However, the visa number would not be available to your friend for about 12 years from the date I-130 was received by USCIS (that's the current wait). Until then, he won't be able to apply for adjustment of status, and neither will his wife. Did his priority date become current yet?

he will fax me his approval notice tomorrow so I would understand better the case. but he applied for this thing 5 years ago. in the notice, they asked him to file I485, doesnot that mean he is good to go?

in LC I said 5 years sound right. I take that back. Tell me what the priority date is for his case.

To NIW;

Hi! I have a question for you, please help me,I am trying to differentiate the Notice of Action for my approved petition (I-130) with the notice of action to approved petition of your friend.

To be more clearly, this is my problem when my husband and i filed my Petition for Alien relative (I-130) we put at the second page that i am in US and will adjust status in Agana, Guam, but after a thorough research I found out that I am not in US since I am in Northern Mariana Island(US Territory beside Guam) and since my husband is in California right now. I should not have put that I am in US and can adjust status.

I called my husband just now, and I asked to read the Notice of Action to my approved I-130. ANd it says there that this approved petition will be sent to National Visa Center. And accroding to you, your friend was asked to file I-485. Do you think I still need to file the I-1824 to inform them to send my approved petition to National Visa Center, since it's there already in the notice of action.

Please help me figure out. I will really appreciate, Thank you very much.

There is something here very important to understand. You just adjust status/AOS/I-485 when you are inside the US. When you are outside the US you go through Consular Processing.

Chery,

Thank you for your reply. Do I still have to file the I-1824? To ask them to send my approved petition to National Visa Center. Do I need to make a letter or just submit that form?

Thanks again. Hope you can help me.

if your notice says it will go to NVC, it's going to NVC already. If your notice said: 'you indicated that you will do AOS, please proceed", that would mean the USCIS expects you to adjust status.

Lucy,

Thank you very much. You save us for paying $200.00. I am really worried about that. I really appreciate.
