I am an H1 visa holder for the past 3 years. Prior to being an H1, I was an F1 for 4 years- got my BS in US. My initial H1 visa was stamped in my home country, while the second was renewed at the DOS. The latter expired in Feb 2005.

I want to renew my visa in Montreal, but the situations, which I am going to mention below, am afraid will cost me a flat out rejection. I am hoping to hear from those who were in some similar situation and have successfully renewed their visas in Canada (if not Montreal). Any input you can provide in this matter are very much appreciated.

Here are the situations:
  1. Nov 2004, I transferred to a new company. I got a new approval. So it's not going to be just a plain revalidation.
  2. I renewed my passport recently. In my new passport, there is no visa stamp at all. But I will also submit my old passport that have my F1 and H1 visa stamps.
  3. Back in 1999, as an F1, I went to Canada to get a visa and was rejected because they could not determine my tie to my home country. At that time, my passport had been stolen and I had come to canada with a new passport with no copy of my previous visas, only a copy of I-94. I wonder if my past rejection will hurt my chance of getting a visa in Canada now.

On a side note, upon rejection, I went straight home and got my visa then. After that, I've renewed my F1 and H1 visa with no problem, but they weren't done in Canada.

Please advise....

Thanking you in advance

------ that is not the problem if you take full H1 petition copy that include copy of form I-129+LCA certified by lawyer who filed latest H1 petiton
  • I renewed my passport recently. In my new passport, there is no visa stamp at all. But I will also submit my old passport that have my F1 and H1 visa stamps.
---------------- keep both the passports stapled
  • As an F1, I once went to Canada to get a visa and was rejected because they could not determine my tie to my home country.
-------------------- F1 has no dual Intent like H1
At that time, my passport had been stolen.
----------------- this CAN create problems, becasue if passport was lost or stolen it is not straight case
I had come to canada with a new passport with no copy of my previous visas, only a copy of I-94. I wonder if the fact that I was once rejected will hurt my chance of getting a visa in Canada at this time.
-------------- lost passport may be problem, but if you got H1 later stamped on your passport then good chance as you have US degree
On a side note, upon rejection, I went straight home and got my visa then. After that, I've renewed my F1 and H1 visa with no problem, but they weren't done in Canada.
------------------ if after passport was lost you got H1 stamp then good chance for H1 stamp
***** if Visa gets rejected be ready to go to your home country directly from Canada ( very less chance of rejection becasue you have US degree)
Please advise....

Thanks

Ginnu,
Thanks for the reply.

To make things clearer, I've edited my original post.
But your advice still apply. Thanks again....
