I Smoke, I drink & I'm in removal Proceedings.

My family had a legit case in Florida but I made a change of venue to California.
I'm now in removal proceedings and was transfered in front of the Immigration Judge. I already underwent the first Master hearing and I'm scheduled to appear early in 2009.
My family was approved but I was denied due to some mistakes from USCIS part. My current situation I already hired a very $$$$ Attorney, she actually has been recognized as Super Attorney in 2006-2007-2008. We re-apply for asylum again but the judge seemed to have made up his ming after seeing my long arrest history.
My question is as follows....I smoke I drink, I'm the captain of the boat in every party.. and have a criminal history...Do you think that I will get aproved...If you were my judge what would you do??

Be honest with the judge and tell him the truth. Show him that you are really sorry about your past and promise to be a better citizen.

Maybe that can help. The judge is also an human.

In your case, you should hire a criminal defense lawyer, not an immigration lawyer.
 
IN my opinion, if u don't lie to the judge, u have pretty nice chance (aout 90%) to get approved, 'cause u r straight forward guy so that goes in ur favour..........I would say never give up try try again ..........................when u go for an interview think positive and tell Mr.Judge that u r a changed man .

Well, I don't know if the OP is serious or not (the "Super Attorney" part was over the top), but there are many crimes that make a person ineligible for asylum. A person with a criminal history should consult with an immigration attorney to find out if he/she is even eligible. There are also many crimes that make a person ineligible for withholding of removal. However, even if a person committed murder he/she is still eligible for deferral of removal under the UN Convention Against Torture, provided that he/she can prove his/her case.

Ultimately, even if a person is eligible the Immigration Judge has discretion to grant or deny asylum.
 
you must understand the intregrity of the the immigration benefits.
You must change your behavior and stop committing crimes.

USCIS must not grant asylum to someone who has many criminal histories and arrest records. When you disrespect the laws of the country, the law will punish you hard and it should.
responsibility and accountability lesson is something you must learn.
I wish I could give you better advice but US agents don't want to let someone stay in this country who disrespects and violates the laws of this country.

Ok.. I have a DUI.. and a False representation to a peace officer mideaminor..and as I mentioned my attorney is working hard (that's what she says) in my case. and about the superattorney is not a joke is for real ..they get chosen by the bar appointed by fellow attorneys. However that's not the point..I also have been placed in the Student honor list for Fall 2007 of my college and I have the certificate of it.. Also I have outstanding grades.. and a current GPA of 3.25...(i know that it is not relevant to my case but you think that..it would show good moral or behavior.) In my post I just wanted to make fun out of something bad...it's tru I smoke & drink and party but it is also true that I'm a very hard working person and a good student. do you think that it is good idea to show the judge all this things or he just don't care!!

I was an dependant of the principal (my mom) but I got kicked out of the asylum by USCIS mistake.Now my asylum is based on my previous asylum application...claiming that if I go back they are going to use me in order to get to my family that already have asylum.. here in which I was...any suggestions??

Just don't get caught smoking/snorting the wrong substances!! Can bite you in the ass for citizenship too! Good luck with your application man. And I thought you were kidding about the Super Attorney too till I looked it up. It's real! :)

like my parents do!! instead all I have is a next Merits hearing in front of a cold hearthed Judge!!

Good luck man...As far as I know, in the US you are not alone in smoking, dringking, and all that staff...but you might be alone in being in removal proceedings...and by the way you have nothing to worry. That staff is availible every where in the world. If they deport you, will find them in every corner of the world, so don't worry you are in good shape
