I need help to apply for my green card

I am 20 years old. I currently live in Southern California. I am beneficiary of my father who came to US, got political asylum few years back. I came as beneficiary to my father last year. I need to apply for my green card. I’ve been in US for one year. Now I want to apply for adjustment of status to obtain a green card. I am filling out form I-485, I-693, G325A (biographic information). I got medical exam done in my home country before I got the visa in January of 2009. I have the following questions.

Questions:

1. Do I need to get medical exam done again for form I-693. I submitted my medical exam information at the port of Arrival, do I need to get a new medical exam to fill this form or should I just submit the vaccination requirement.

2. I also received employment authorization last year in March 2009, which is valid till March 2011, do I need to submit to another form. I-765 along with adjustment of status paper work or will I get my green card before March 2011.

3. Please give me any advice regarding the forms. Where do I need to submit the forms?

Any advice will be greatly appreciated
 
1- yes, you will need medical exam, however, you can submit your medical and vaccination records to the doctor.

2- you don't need to get another EAD

3- based on where you live, check the I-485 instructions or this link

abawarchi, if you've received your full approval ( for asylum or derivative status ), you won't ever need an EAD.

My father has already received green card based on asylum.


1. I am getting my vaccination record for home country, should I take that to the doctor to get the form I-693 filled?

2. When I came to US, my father was unemployed therefore I took food stamps for one month and I also applied for medical since I had to go to the ER for a severe ache. However, the food stamps were stop after the second month but I still have medical, will this be any problem for the green card process?

For no. 3) Asylees and derivative asylees are not required to prove that they are not likely to be public charge. So, those assistances won't be a problem for your GC application. GL
 
There is a column on the form I-485, part 3 asking for non-immigrant visa number, I got only one piece of paper from the consulate, but there is no visa number on it (There is no visa attached to the passport either). So what should I put under “Non-Immigration visa number”. Also I am a beneficiary of my father who was granted asylum, so to the question in part 3 of I-485 (In what status did you last enter?) What would be my status? Asylum status or beneficiary asylum status? . Additional, in part 2 (application type) of I-485 form, I checked D (I was granted asylum or derivative asylum status as the spouse or child of a person granted asylum and am eligible for adjustment) or do I need to check something else?
 
abawarchi, its been almost about 25 days that i filed for my GC and I haven't even received my receipt yet. But at the same time, one of my compatriots who did his biometrics earlier this month received his GC in a month. So go figure.

I heard that Texas Service Center has a quick process. They process applications within 1-4 months.
 
Well I sent it to NSC. Like I've already mentioned earlier, I have three reasons to be impatient. 1. My dad's application on hold and I wonder if it will affect me. 2. I've applied for a fee waiver. 3. I'm 24 now and I'm not sure if I'm still eligible to apply GC as a child or whether I should be applying for Nunc Pro Tunc Asylum.
 
Just a Question. I thought that I-485 should be filed at either Phoenix or Dallas Lockbox not Service Center? Is that correct?
 
I stand corrected then. That certainly explains why I haven't received a receipt in almost 4 weeks.
 
almost 6 weeks now, still not even a receipt. I'll be kicking myself real hard if they rejected my petition for fee waiver.

Call USCIS 1 800 375 5283 press 1, 2, 3 then tell them that its been over 30 days and you haven't received your receipt, they will escalate your call to the Officer, but you need your A- number to get the info about your case, the officer will even give you your receipt number, in that way you will know whether your fee waiver has been accepted.
 
Takuru, I called them after 30 days. And as soon as I mentioned the fee waiver, an officer told me that it might take up to 90 days before they'd even send me a receipt ( let alone tell me whether my waiver has been accepted or not ).

So, I called them again, 3 days later. This time, I didn't mention fee waiver :D and I was told that its actually 30 business days. I'm not sure if they'll be able to tell me whether my fee waiver request has been approved or not though......and thats why I'm actually starting to worry. I mean, if they rejected my request, then I'd have lost at least 6 weeks!

The only consolation amid all this is the fact that a compatriot who also filed for her GC 2 days prior to me has only received her receipt. She's yet to receive a notice for biometrics....
