I'm a mexican guy, over 21 years of age, My father(mexican)is a permanent resident and he petitioned for me in 2004 and it was approved. I've heard it will take 12 years more for a green card to become available for me. My father also petitioned for me in 1992, when I was a minor and it was approved too. But we never heard or had any news from the lawyer, the lawyer never said anything, but we later found out, that my appointment was ready on 1997. But the lawyer never never said anything never looked for us, so I blame it on the lawyer, it was his negligence. The case in 2004 was done by another unprofessional lawyer, because he never said anything about the 1992 petitioned.I did tell the former lawyer that I had another petition. but he never said anything either, most unprofessional lawyers just want easy cases and easy money. The 1992 petitioned was canceled by immigration due to lack of response by the lawyer. So my question is, can the 1992 case be reopened due to my former lawyers negligence. Can something be done to reopened the 1992 case, maybe by talking to a judge??? is there any chance?

It depends on where you are.

The old petition can be used to grandfather under 245(i) IF you have been in the U.S. since at least December 2000. It depends on the details.

Talk to your lawyer if that is a possibility for you.
 
I live in the USA. I have lived in the US since I can remember, since maybe 2 years of age. I have never gone to Mexico. I don't have criminal record of any. The problem is that the 1992 petitioned was cancelled due to lack of response on 2004, just when the second petitioned was filed, I dont understand why the lawyer didnt do anything about it.Yes I'm searching for a really professional lawyer in my area, hopefully I can find one soon.
