I applyed for US citizenship and my application was denied?

my BF applayed for US citizenship but his application was denied, due to him still serving probation for misdaminor that he got 3 years ago, his probation ending this June. my question is can he applay again after June or he has to wait more time? and how smaller chances to get US citizenship after first deny?

oh btw before he applayed first time he cleared his record and we talked to lawer and she said that it has to be no problem as soon as he is not on probation. i just dont know should he applay after June like in July?

do u think we need to hire a lawyer?

i dnt know what CIMT stands for but he has misdaminor for receiving and selling stoling property...
 
The misdemeanor charge can be a CIMT (crime against moral turpitude). For example, in California, receiving and selling stolen property falls under PC 496 which has been found to be CIMT in past. Find out the exact charge and get a second opinion from an immigration lawyer specialized in criminal law.
 
How to count 5 years?

Do you know how to count 5 years? is counted from conviction or event happened, or sentencing or others?

no way i never heard about 5 years OMG thats so weird
OK i talked to the lawer and she told me that he can applay rite after the probation ends they have to give citizenship again, jus bacause the crime was 3 years ago, its misdaminor, he graduated from the college going for another major, working at the hospital i mean what else do they want to call him as good moral person:confused:

5 year from end of sentencing - i.e., end of probation
It is not 5 years after the end of probation. It is 5 years after the conviction, provided that probation has ended by that time. But if the misdemeanor is not a CIMT, he can reapply after the end of probation without waiting the 5 years.

how can i find out that whatever he did is not CIMT? he was charged for recieving and selling stolen property (his friend stole the car and brought it in his garage, what happend after its easy to figure out)

As I mentioned in the previous post, find out what the exact charge was (from court documents). If it was in California, most likely it was PC 496.

I am confused as two lawyers told me count 5 years from Sentencing, another told from probation, another said from verdict.
 
5 years from conviction
meaning the day that the sentence(suspended,or jail) was given.
example if this happened this year 2009
jan 1st :incident ocurred ,arrested ,etc.
march20: arraingment at court
april 20 :sentence day :given a fine ,community service,dv clases for a year and 36 months provation.
if it was cimt the date to apply will be after april 20 , 2014.
dates given to me by a immigration lawyer.
