Hello everyone,

I am in the trouble. I got stucked with I-864. My mother, ( US citizen since 1976 ) submitted petition for alien relative I-130 four and a half years ago and the petition was approved.

Before I proceed ,here are few informations that may be relevant:

-My mother lived in the US for eight and a half years (1969-1977)
-I was born in 1978
-I came to US on tourist visa (B1/B2 - valid for 6 months) in March 2000 and left in February 2001 back home(I did no law violations, and I've properly extended my visa for another 6 months)
-My mother filed I-130 in January 2001
-Petition was aproved in September 2004 and classified as F1 (family first preference)

Immigrant number is available for my case since February 2005, I think. The problem is I-864. My mother (she is disabled person) doesn't live in the US for the last 28 years so neither she has "domicile" nor she can be my only sponsor(no income in the US). Although, she is planning to go back to US soon. And "joint sponsor" seems to be hard to find these days... :mad: (all those "dear cousins" who were there when they needed us and to which we borrowed sh*t load of money once, now don't seem to be willing to give a hand...)

Is there any way that I could benefit from 245(i) ? Do persons who file I-485 also need Affidavit of Support?:confused:


What should I do? ANY thougts or opinions are wellcome!

Yes she was US citizen when I was born. But for persons born in the period from 24th of December till 13th of November 1986, (if only one parent is US Citizen), period of ten years of physical presence, at least five of which were after attaining the age of 14 in the US prior to the birth is required to transmit citizenship to a child. I was born in July 1978 and she was there for 8 and a half years. So I can not be citizen at birth. :(

In the 1986 they changed that requirement from ten to five years but change was not retroactive...applies only those who were born on or after 14th of November '86...
