Hi

I am L1 Visa and my Wife is Green Card Holder.

My L1 visa is expiring in Oct 2010 but i do have Valid I-94. I-94 is valid till Nov 2011.

My Wife will be eligible for Citizenship in Sept 2011.

What should be my next Step ?

Thanks

She got her GC in 2004 but due to non continus presence in US she will be eligible for Citizenship in Sept 2011.

You're probably best off waiting until she becomes a citizen, then filing the I-130/I-485. I doubt an FB2 priority date will become current before then. Have you used up the 5 years on your L1?

Then I'd wait for your wife to become a citizen, and get the L1 renewed for another two years. You should be fine. You could have her file an I-130 now on the off-chance that her citizenship might be delayed.

You are on L1? So why do you say you had a green card since 2004?

Anyway, I would recommend filing the I-130 right now because Sept. 2011 is close to the 2012 election year, so there is likely to be a flood of citizenship applications and a resulting slowdown, possibly pushing your wife's citizenship process into late 2012. If she files the I-130 now, you might get a green card in family category 2A before she gets citizenship. Or at least become eligible to file the I-485 before she gets citizenship.

The October visa bulletin showed another good forward movement ... as of October it is only a 6-month wait in the F2A category. That makes it even more likely for you to get a green card before she gets citizenship, if the I-130 is filed right now.
