I-94 stamping/Passport expiring

Hi!

I am planning to go to India on March 29. I have a valid H1B visa in my passport. The H1B visa expires in December 2005 but my passport expires earlier in June 2005. When I re-enter US (sometime in April 2004), what would be the validity of the I-94 issued at that time? I heard that, in such cases, they are currently issuing I-94 valid only till expiry of passport. I feel, this is not correct, because I plan to get my passport renewed when I enter U.S.

Has anyone of you experienced this or has any more information on this?

I feel, this is not correct,
---- That is law, they can’t give you I-94 beyond passport expiry date, you can get new passport when you are in India, I hope one can apply new passport 1 year advance, check Indian embassy or nearest Indian consulate site
because I plan to get my passport renewed when I enter U.S.

Has anyone of you experienced this or has any more information on this?

Ginnu - thanks for the reply.

The thing is - I cannot renew my passport right now because in not in the one-year-expiry window yet. It won't be so till I re-enter U.S. after this trip. So what are my options?

Then get the I-94 till passport validity and later get new passport from Indian consulate in USA, exit USA and enter with new I-94. Who knows the POE officer may give you I-94 till your Visa stamp if he looks at only Visa stamp (I don’t know how they gave you Visa stamp in passport beyond the validity of passport expiry date, normally Visa stamp is also issued till passport expiry date)

Your idea of exiting USA and getting a new I-94 sounds like a good one. I probably will have leave and enter USA before early next year anyway.
