My H1-B visa (stamping) is valid till Jun 2004. However, when I entered US a few months back, I got an I-94 till JAN 2004. I discovered that recently. Now I am planning to file I-102 at my local USCIS. Can someone tell me:

- How long will it take to get the new I-94 ?

- Is it possible for me to go to Canada/Mexico and get a fresh I-94 while re-entering US ? Will I need a visa to go there (I am Indian citizen)

or any alternatives ???? any suggestions welcome !

------------ it will take time

------- You can do that but remember that when you enter Canada or Mexico they don’t ask for you to surrender your I-94, because they are not interested in US matter but if you give your I-94 to them they will take it and then send it to US immigration border post and while you enter US from Canada or Mexico you can get new I-94 if you have valid visa in passport they will charge about $ 5 or 6 for the I-94 at border post, if return by air then they will not charge for new I-94

Will I need a visa to go there (I am Indian citizen)
------ YES, you need visitor visa for Canada or Mexico
or any alternatives???? any suggestions welcome

*** Best option is go to the same POE where POE officer did the mistake and ask for the correction, or meet the supervisor and they will correct it

Thanks Ginnu ... however, I got this I-94 from Chicago airport 6 months back and I live in Los Angeles. I doubt if I can get hold of that POE. Also since my I-94 is already expired, I am not sure if I will get Canada or Mexico visa. I guess they would check my valid visa status here as a part of their visa grant procedure. Or won't they ?

Please reply ....

--- I think you can get Canada Mexico visa they only will check the valid Visa and with visa application you can also submit employer letter that you are working with them and attach 1-2 recent bank statements (take out the expired I-94 from passport when you go to Canada consulate or Mexico consulate to get Visa. I think Mexico will be better for you. I went to meet a friend in CA last month (Vidal junction) he told be let us go to Mexico border as he wanted to buy some medicines from Mexico I had my friend who with me who was/is on H1 status and he also went with us and entered Mexico with out any Mexico Visa as nobody was checking the passport or Visa when we entered Mexico and we had food Mexico side my friend bought the medicines and we entered the US border post gate they just checked my passport and my friend passport and H1 holder passport and H1 holder had valid I-94 and young officer asked if he need new I-94? The H1 holder told as you wish then officer told him you don’t need new I-94 as your trip is less than 30 days, so we came back with out any problems for H1 holder( I think officer had the knowledge about Automatic Visa revalidation rule) I don’t remember the name of Mexico border post it was 2-3 hours drive from Vidal junction CA ( Vidal Junction is about 2 hours from Las vegas)

----- If you go to Mexico by any small border post I don’t think they care about Visa and Mexico visa is not difficult to get

Thanks a lot for the detailed reply. I was thinking of going to Mexico but my company lawyer suggested to visit the local USCIS office first. I went there and explained that this is a mistake from the POE officer's side. They checked my 797 approval and visa and made me fill an I-539 form (I-94 correction through I-102 is no longer possible) and sign an affidivit and then gave me a corrected I-94 immediately ... they did rebuke me for being negligent though.
