Hi!
I have a question regarding H-4 Visa extension rules in relation to I-94 issuance upon reentering the US. My passport-stamped H4 is valid until May 2005 and so is my (white) I-94. I have recently got my H-4 extension document valid till Sept 2006.
First part of my question is that if I go out of USA should I be surrendering both I-94 (White one and the lower right portion of my new H-4 document)? or just the White one?

Secondly, I am returning to US before my stamped (previous-H4) expires. How POE officer would determine, whether he should give me entry until the stamped visa (previous H-4) or until the expiration date of my newly issued H-4 document. I would also like to mention here that my Spouse\'s company name is different in both my H-4 docs due to company change recently. I’ll be anxiously looking forward to your response, Thanks.

You just need to surrender the white I94 only. Not the one with your approval notice

Secondly, I am returning to US before my stamped (previous-H4) expires. While entering in US if you show the approval notice along with ur Visa on the passport then the officer will give the I94 valid till Sept 2006. Since u are returning before ur Visa expire then u will be fine. Next trip u need to get the visa stamped before entering US.

Thanks a lot for your quick response. I am wondering if you would also address the other issue for me. i.e., Since my spouse's company/job name changed in the newly issued h-4 extension document, would that be an issue on reentering or in other words does that particular reason requires a new visa stamp on my passport before I reenter US?
Also, could you please elaborate why I should not surrender the lower portion form my new H-4 document?

------- surrende both the I-94( white and that came with H4 extension) by law you need to surrunder both when you depart US. at airline counter ask for pin or staple and staple both your I-94 and give at airline counter ( for your records keep the copy of both the I-94 front and back for your future records)
Secondly, I am returning to US before my stamped (previous-H4) expires.

How POE officer would determine, whether he should give me entry until the stamped visa (previous H-4) or until the expiration date of my newly issued H-4 document.
------ if you show passport visa stamp AND H4 approval notice you will get I-94 till your H4 approval notice
I would also like to mention here that my Spouse\'s company name is different in both my H-4 docs due to company change recently.
----- that is not a problem if spouse changed the company, you can enter with visa stamp of past employer name on it, you are not tied to any employer your H4 is tied to your spouse H1 status
I’ll be anxiously looking forward to your response, Thanks.

------- I would get passport renewd and will keep the cancelled passport and new passport stapled. I dont know your PP expiry date and Validity of H4 extension

Thanks for your response,
My Passport would still be valid for another 7 -8 months when I'll appear to POE officer upon my return. But my H-4 Extension doc has a date which is one year beyond my PP expiration date. I.e.; Passport expires Nov 2005- H-4 Ext: till Sep 2006- my intended Entry in US by March, 2005.

Please suggest.

------- I will get my passport renewed it takes onlt 1 day in NYC India consulate and Indian Embassy DC gives new passport second day .

I called the Embassy for passport renewal. They say I can only do it if there are less than 6 months left before passport expires whereas, I have 12 months on my current passport before it expires.
Any suggestion...will be very helpful. Thanks.
