I-94 issue for my H1B visa

Hi,
when I came back to NY last Octorber, the immigration officer in JFK stamped on my I-94 dated Oc.30th, 2005, when is my passport expire date, but my H1 visa is till August 1st, 2007. I was told after I extned my passport, I can get teh same date as my H1B visa's date. Can anybody kindly advise what's the procedure to get my I-94 new date.

I had exactly the same issue. In fact, based on my passport, the officer stamped everybody in my family with the expiration date on my passport rather than the H1 date. When I got my new passport (was mailed to me, I had already applied in my home country) what I did was I went to the local BCIS office (Boston) for me like at 6 AM. At 8 got in, got a number and spoke to an officer, explained the situation and she gave me 4 new I-94s with the correct date (til the end of my H1).

Go and extend I 94 through a local office or through a service center (Service center take 180 days or more)

the immigration and nationality act states in the Sec. 212. [8 U.S.C. 1182]:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States: (7) Documentation requirements.- ...i) In general.-Any nonimmigrant who- (I) is not in possession of a passport valid for a minimum of six months from the date of the expiration of the initial period of the alien's admission or contemplated initial period of stay authorizing the alien to return to the country from which the alien came or to proceed to and enter some other country during such period, or
 
Was unable to get new I-94 at local USCIS office

I have a similar case where I-94 was dated for expiry of old passport and now I have a new passport and would like to have the date corrected. I went to the local USCIS office in Charlotte NC after taking an appointment.
When I went there and went to explain my case, the officer at the counter said that they dont issue any I-94's here and that I had to go to the POE. More than that she got confused and said that I needed to file I-539 (change/extension of status) if I needed to get a new I-94 with the correct date. :confused:
I would be very thankful if anyone could post exactly which centers are capable of giving the I-94s, and as to which procedure/appointment did you take in order to get the new I-94s. dewey_daniel and 161, could you please post your suggestions as to what I should do.

If local office is not willing to handle, you have to apply to Service center, may take 180 days, or if you have valid visa in your pp take a short trip out side US and come back with new I 94.
 
I went to local USCIS also

I went to the local USCIS in manhattan also last Friday, the officer in the information office told me no need to get an extension since I have the I-94 from my original I-797. I left and wasn't sure if she understood my situation so I lined in again and asked another officer, but I got the same answer. I'm quite worried, maybe I should ask my lawyer. :confused:

That is exactly what happened with me too. The officer saw the I-797 and one I-94 on it (the other one was taken when giving me visa in Mexico), and said since I had I-94, I was fine and I didnt need to do anything. But that I-94 was from waay back and I dont think she understood no matter how many times I explained that I got many I-94s after it.

I am not a lawyer, but I think a better way to explain the case is to approach them without showing the I-797 first and request a correction to the I-94 instead. Showing the I-94 on the I-797 is completely throwing the request off-gear. 161, what do you think of this? Unfortunately I have to day a complete day off and travel to another city to request again :( .

One more thing I did is to call up the BCIS people at Atlanta-Hartsfield airport (where I enetered with the old passport) and asked them what I should do. The officer who talked to me said I could go to the local office and get a new I-94 in one day (though experience has told me otherwise). He said the Atlanta office would process it in a day, though dont know how to convey this problem correctly to the officer at the local office at Charlotte. Is there any difference between the offices at Charlotte and Atlanta?

Call the Port of entry or any international airport near your house and go there to get the date changed. CBP has a website and representative who will tell you where to go. I had this problem and got it corrected at the airport where I am currently rather than at POE.

tangohi, I called up CBP at two international airports and both of them said to re-enter in order to get a new I-94. I was wondering as to where and how did you get the I-94 changed? :confused:

Conclusion

to conclude, I went and got a new i94 from a border post. it seems they used to give i94s at airports but dont anymore.
