I-94 form questions

Hi Friends,

I have a question regarding my I-94 form. I forgot to return the form I-94 (I worked with H1B for about 1 year in the States) at the border when I left the States for immigrating to Canada 6 years ago. Now I have an offer from An american company. I just wonder if the above issue will affect my H1B application and the future GC petition. Thanks for your input.

----- You did a mistake because if you did not surrender your I-94 they don’t have any record that you left US, they may conclude that you are still in US. If your I-94 has been expired they may think you are still in US and staying illegally. You could have submitted your I-94 to any US consulate in Canada with affidavit that you forget to surrender your I-94 on XYZ date or Canada immigration at the time of entering to Canada did not ask for I-94 that way your record would have clean. If still you have valid I-94 go to nearest Canada border post and walk up to US immigration and give them your I-94 with letter, Toronto airport has US immigration you can also give them your I-94 or give it to US consulate, US embassy in Canada keep the copy of cover letter, copy of I-94(front and back) with you for future records. you may also submit evidence that you have been in canada or working in Canada( send the tax fiing copy or letter from employer

I got a 10 years B1/B2 visa in 1999 from a U.S. Consulate in Canada. Do you think my record is clear afterwards?

----- if you got that B1/B2 visa AFTER your departure from US then you are clear
 
I think if you have left US before 1/5/04(date when US VISIT came in to effect) and forgot to return the I-94, it really does not matter. As there is no way they can prove that you have not returned or you did return and the airlines gate rep misplaced it. One of my friend went to India and forgot to return I-94 but he entered without any prob.
He may be lucky to get away with it. As told by ginnu..its safe to talk to a attorney.
