I-94 and H1-B interview

Hi,

I was hoping that someone with a little more experience here could tell me whether I am in trouble or not.

I started employment on OPT post graduation in July 2009, and my employer applied for an H1B on my behalf. I received an approved notice of action (Form I-797-A) indicating that my status would change starting from February 2010.

I came back to my home country (India) on the 5th of December (yesterday) to do the visa interview, but I realized that my I-94 cards were never taken. I still have my boarding passes, and am planning to send the I-94, as well as copied of my boarding passes and all of that information to the office mentioned here:

My concern is that my visa interview is in 4 days (on the 10th), and I doubt that the paperwork will get to the US and be processed in that time. I plan on making a copy of the I-94's as well the documents I send to the US, but will only bring them out if I am asked.

Will this jeopardize my interview? Is there any other paperwork that I can and should bring?

Given how soon my interview is, a prompt reply would be appreciated.

Don't send it in as yet, take all originals with Boarding cards etc to the interview so you can explain the airline's mistake easily.
Now before you travel back to the US it is absolutely necessary to have this taken care of and maybe while you are at your interview the embassy will help you to fix this as well by maybe providing some kind of a letter for CBP or maybe sending these themselves to the Kentucky address.

---------------If asked, FYI the Embassy or consulate will NOT send the I-94 to CBP Kentucky address once you get Visa stamp then send it to Kentucky address in US and keep the copy of each document front and back with you. also keep the Copy of Cover letter that you will send to Kentucky address US.

Rule for any interview, never volunteer for any information, answer what is asked only, if they come about the issue act surprised and present all the evidence as if you happen to have them with you in your brief case or whatever and ask for their assistance, remember sometimes innocent ignorance is an excuse, if you tell em that you knew what happenend they would think you knew it before hand and still didn't went the extra mile to make sure they are turned in while getting boarding card at the airline counter.
You should do OK because you are not responsible if an airline employee is not doing his/her job properly.
