I-864 question

My Wife a USC is filing for my Green card. She has filled out the I-864 form and she meets the income requirements listed in I-864P. Would it help if i (The beneficiary/intending immigrant) also list my income on the I-864 or will it cause any other problems?

If wife's income is not sufficuent, applicant can use own income. For that I believe the process is little different (additional form). Please check complete I864 instructions.

If your wife's income is sufficient, listing your income should not help or hurt either way.

If she meets the requirements, leave it at that. Don't give them any more paperwork than needed.:p

Make sure she submits
:
Letter from employer verify wages/salary, date of hire, job position, hours per week/month.

w-2's

tax transcript (2006)

pay check stubs


When you have interview, they may ask if you are working. You can submit or verify that with your job information.


You will be fine.;)
 
does I864 need to be notorized?

I have told that I-864 needs to be notarized. I have only seen the requirement for the 864A (i.e. joint sponsors) but not 864. Can anyone help to clarify

My Income or as per Tax Return

I am filling out I864-EZ for my wife. She worked in 2004, 2005 and part of 2006. I am employed with my employer since May 2005.

I have 2006 W2, 2006 tax returns, letter from employer, 4 current pay stubs.
As per 864P we are meeting the guidelines.

For 2006 and 2005 I can document my income through W2 and tax returns. We did joint return.

For 2004, I have zero income, but my wife was working then and we did joint return with that.

2006 (Most Recent) - $
2005 (2nd Most Recent) - $
2004 (3rd Most Recent) - $

1. What do I put in 2006 and 2005 - my income only or as per tax return, i.e. joint income.

2. What do I put in 2004 - my income ($0) or as per tax return (my wife's income)

3. If I do the Optional Section, i.e. attach Tax Returns for 2005 and 2004, then my problem here is that in 2004, my income was $0. So I am thinking of not checking this option, but still I need to know the answer to Question 1, 2 above.

4. In my case do I need to add Assets info.

5. Are they concerned with current situation as of 2006 or will 2004 also matter to them.

They have changed from requested past 3 years of tax info. You only have to submit previous year (in your case 2006 tax info with the 864). Just as long as your 2006 income meets the federal poverty guideline, you are ok.
