Hello,

Recently, NVC has sent the Affidavit of Support form to my mother to file for me.. My I-130 approved in 2005. Both my parent are gc- holders, working and earning well in India and filing income tax return in India.

Do he permanent residents have to file US Federal income tax if they are working in India? Their US income is 0.

This form has a check-box only for federal income tax return (Part-6, question no 25). Can they provide India's income tax return?

Does this cause any problem?

I heard, for permanent residents if they are not earning in USA and if their global income is above $40,000 then they require to file US Fedral income tax..I am not sure..I guess,, I need to consult an immigration lawyer..My parents have got re-entry permits every single time they applied...
 
If US Resident/US Citizen lives outside of USA and has worldwide income they should include in US 1040 form and can take foreign income exclusion. This exclusion amounts were 2009 $91,400.00; 2008 $87,600.00; 2007 $85,700
 
Thanks..But if their worldwide income is not above $50,000 then are they still require to file the form 1040?

If it is required by law to file, then they can still file for the amendment tax for the last 3 years even with zero income....That's what the form says...
