I-797A Help

Hi,

I was working for my prior employer on L1 till 12/31/08 and therefore had valid L1 status till that date. My L1 visa and original I-94 were valid till 9/12/09.

I filed I-539 for COS from L1 to H4 (receipt date: 12/30/08), requesting an effective date of 1/1/09.

My petition was approved on 3/17/09. The I-797A has a "valid from" date of 2/17/09.

I am concerned about my status from 1/1/09 to 2/16/09. Would I be in valid status since the receipt date is 12/30/08 or do I have to re-petition USCIS to have a "valid from" date of 1/1/09?

Pending application gives you authorized stay and from 1/1 to 2/17 is considered that you were legal to stay in the US.
