Any idea how long does it take to get a I-730 approved. As my spouse and children are here do I still need to submit a marriage certificate the thing I don't have a marriage certificate as it was destroyed when our house was burnt down back home. All I have is the children's birth certificate.

Please Advice

I would check this with an immigration attorney. I would also e-mail Gilbert (moderator) for his opinion. Others in this forum would also give you valuable advice, as they always do. Having childeren from the woman you mentioned doesn't necessarily indicate that you are legally married. I would seek a legal advice on this.

It takes more than one year. this message I received when I applied

Your I730 REFUGEE ASYLEE RELATIVE PETITION was received on March 4, 2005. Your request for a waiver of the filing fee has been granted. We mailed you a receipt with information about processing. It is taking between 450 and 480 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

My cousin who applied in April 2004 was interviewed in January 2005. But he 's still waiting your approval decision.

Ok so if it takes 1 year. Now I will be eligible to file I-485 in Nov2005 so if I don't receive an approval for the I-730 can I still file I-485 or do I have to wait until the I-730 is approved for my family.
 
I know that I will be eligible what I am trying to ask is if your I-730 is pending can you still file I-485 for your family.

I think that person need at lease one year after got his/her asylum status to be elligitible to filled I-485.

Because I-485 for asylee need that person to be an asylee and physical live in US for one year and above.
 
Ok is it a yes or a no can some advise on this matter. Also on the I-730 do we need to put the SSN numbers as my wife was working illegaly when her H1B expired. Will that create problems for my wife.

You can file your own I-485 in November, as soon as your year is up, no matter what other applications (I-131, or I-730, or I-765) you have pending at that moment, but your wife and children have to wait until one year after their I-730 approval to file their own I-485.
So, that’s a NO.
Also, to you previous questions – you do not need a marriage certificate while filing I-485 for yourself, but you do need a copy of it when filing I-730 for your wife and later she will need another copy when filing I-485 for herself ( as a proof your relationship existed BEFORE you were granted asylum).
If she has a SS number and paid her income taxes in a past you have to provide that information in the application.
About her working illegally.... simply omit that information on her G-325A (she could just stay home and take care of your kids and your home for all INS knows…) and as long as there is no proof of her working illegally, she should be OK.

I may be wrong, but as far as I understand it doesn't metter if your wife is a derivative asylee or not. She'll have to file her own I-485 in a year after her I-730 approval. BTW I am in the same situation. I am eligible to apply for status adjustment in May, while my wife doesn't even receive her asylum status by that time, since her I-730 is still pending.
 
Peach thanks for the info. Just curious when I put my wife SSN on the I-730 wouldn't the USCIS come to know she has been working illegally and has been filing her taxes also.
 
If your wife used her own SS when working illegally, then INS might find out. I don’t know what to say or advice you about it. I worked while out of status long long time ago as well, but there were no records and I never mentioned that fact to INS and they never found out.
 
so what do you suggest should I put her SSN number on the I-730 or leave it blank. Again if I leave it blank I will be attaching her passport copy as her ID which will show her H1B visa that was issued to her. I don't know what to do.

I suggest you send an email to Gilbert's netscape account for his opinion. He knows more about this kind of stuff than most of us.
