Hello Mr. Jeet

Be prepared for a long fight/hurdles. This embassy has bad history, Even on of its officer (named Mr Kashyap) was arrested on corruption charges. See: http://www.visalaw.com/00mar2/14mar200.html

I am not making you scared, but here's my wife's case history:

It all started with a similar I-730 interview at US Embassy, New Delhi. Handle her case in a very professional and accurate way.

What questions did they ask her? Did they force her to sign any piece of paper (already typed and/or blank)? Did they harass her too much? Did they force her to confess something on verbal assurance that if she accept blah blah blah then they will issue her US Visa? Did they keep her passport? Did they do any investigation from your home town or areas around? Did they keep any wedding pictures ? Please provide all the details. You can send me a PM as well and yes! start seeing your US Congressman and ask him/her to start enquiring on your behalf.

Good Luck and Kind Regards

The I-730 case of a Chinese couple's kids were referred to Guangzhou by NVC
more than 2 years ago. They haven't got any notice from the consulate. Tried everything to contact the consulate, to no avail.

However, another I730 case was processed very fast. It took only 3 months from INS-NVC-Beijing and then from Beijing-NVC-INS. The case was referred back to INS as the VO doubted the marital relationship was not real. The petitioner didn't hand in the marriage certificate when he submitted I589. The case was denied as INS finally didn't recognize the reissued marriage certificate.

I 730 problem

dear mr singh6'
. Thanks for replying ,it exactly happened the way you said. they harassed my wife, forced her to sign a printed paper, tried forcing her to admit weird stuff. im really depressed .
when we call them they dont give any clear answer. the immigration officer asked her ,he will give her visa if she admits whatever he said.
please explain further what should i do?
thanks again

That's a really sad and unfortunate aspects of being a resident of a corrupted country such as India Jeet.

My feelings go out to you and your spouse! Hope everything turns out to be well.

Don't sit and wait. There is a fax number for Delhi consulate. Fax a letter to the consulate requesting information on the processing of the case and cc to USCIS.
They can't deny her I-730 . Their job is to make sure that there is no fraud and that she is actually your spouse. Tell her to be little more assertive. Don't say yes to anything the officer says and she has doesn't have to do anything she is not comfortable with.
But, note that it does take a little longer ; around 1 year on most cases. They deal with these calls everyday sometimes with very impatient people. Call directly from here, be polite and speak to who so ever picks up the phone. That way you can insure that they reading your status from the system and not just making it up.

Asylee13, please look at my wife's case history in the provided link in my previous reply.
Regarding calling them from here, It wont help. Congressman letters will definitely put them underpressure and also he can get more reliable (written) replies from the congressman which he can later use in any litigation.

Regarding denials, they recommend several petitions for denials based on their enquiries/ques-answers etc and send them back to the US in a routine.
Petition spend few months/even a year in USCIS files before getting assigned to some officer.
Finally Petitioner receive a rebuttal letter from USCIS with any adverse information received from US Embassy New Delhi.
Then he/she reply back to USCIS within 30 days. USCIS again reconsider the rebuttal and make their decision accordingly. If they keep petition in approved status then petition goes back to US Embassy New Delhi. And as per my knowledge, US Embassy in New Delhi doesnt object visa issuance at this stage. They dont even interview the benificery.
But! if USCIS do not receive rebuttal intime or they do not like the reply then they deny the I-730 and applicant receive a notice in US. Thats it.

What you are saying is not typical. You have to do really really bad at the interview in the consulate to piss off the officer.
It is a privilege given to the an asylee to call their dependents and i don't think consulate wants to make it difficult. It's just that some cases of fraud might have scrutinized the process.
But, like i said most of the people think that once I-730 is approved it is just matter of days before their dependents will be in US , which is not true. There is interview process, security checkup, medical & paperwork etc that's takes some time. They have to do is, because coming to US is a dream for so many and there has been cases of misusing the process. It is not only a right to enter US but a faster path be a permanent resident and citizen eventually.
