I-539 (H4 Extension question)

Current visa on my passport is expiring in August 2006
but because I have a new I-797 valid till November
2007, at Port of Entry I was given I-94 valid till
November 2007. My wife too got an I-94 valid till
November 2007 based on my status but she doesn’t have
any I-539 approval after August 2006.

Question:
1. Do I need to file I-539 for my wife or there is no
need to file I-539 as she already had I-94 valid till
November 2007 (same date as mine).

2. In case if I don’t file I-539 for my wife will
there be any complications in future?

Yes, you need to file I-539 as that form shows the H4 status and attached to it will be the I-94. Do not be without it and do not leave home without it

there be any complications in future?

Your wife will be out of status and defencding yourself on the basis of a previous will be futile attempt to convince the Immigration authorities.

What I understand that she still has to file I-539 for extension till November 2007 despite having current I-94 valid till November 2007.

My wife too got an I-94 valid till
November 2007 based on my status
