I received a Notice of Action on my I-485.

Notice Type: Transfer Notice
Receipt Date : August 18, 2003
Notice Date : November 18, 2004.

The text in the notice read as follows:

Preliminary processing of the above application or petition has been completed, and it has been transferred to the INS office at:

IMIGRATION & NATURALIZATION SRVC, 650 CAPITOL MALL, ROOM 2-270, SACRAMENTO, CA 95814

That office will notify you when they schedule an interview on the application or petition. Any further inquiries should be made to that office.

What does this mean ? I would greatly appreciate if someone can clarify the contents of the above text and what it means.

Any idea when the interview will be scheduled ?

As the letter says, your case has been transferred to the local office for furthur processing. All you do now is wait. You can call/visit your local office and ask for a general timeline.

this means your case was transferred to the USCIS office and you will be called for the 485 interview. All you have to do is to wait for interview notice and prepare to gather all documents including paystubs, employment letter, photos, tax returns, bank statments, etc. that you already submitted to USCIS office in the beginning.

Check the USCIS internet for waiting times. http://www.uscis.gov. or use https://egov.immigration.gov/cris/jsps/officeProcesstimes.jsp?selectedOffice=63 (see I-485 highlight).

The Notice of Action says 'Preliminary Processing' is complete. Can you throw light on what this means.

Thanks.

Preliminary processing means that your 485 is valid and documents appear ok. You should schedule an appointment at your local office in Sacramento and go visit it and ask for the timeline.

Does visa number required at the time of approval? What INA documents says is visa number is required to apply I-485. But not at the time of approval.

g) Avaiability of immigrant visas under section 245 and priority dates--

(1) Availability of immigrant visas under section 245. An alien is ineligible for the benefits of section 245 of the Act unless an immigrant visa is immediately available to him or her at the time the application is filed. If the applicant is a preference alien, the current Department of State Bureau of Consular Affairs Visa Bulletin will be consulted to determine whether an immigrant visa is immediately available. An immigrant visa is considered available for accepting and processing the application Form I-485 is the preference category applicant has a priority date on the waiting list which is earlier than the date shown in the Bulletin (or the Bulletin shows that numbers for visa applicants in his or her category are current). An immigrant visa is also considered immediately available if the applicant establishes eligibility for the benefits of Public Law 101-238. Information concerning the immediate availability of an immigrant visa may be obtained at any Service office. (Third sentence revised 7/31/02; 67 FR 49561) (Redesignated as paragraph (g) and amended 10/1/94; 59 FR 51091)

(2) Priority dates. The priority date of an applicant who is seeking the allotment of an immigrant visa number under one of the preference classes specified in section 203(a) or section 203(b) of the Act by virtue of a valid visa petition approved in his or her behalf shall be fixed by the date on which such approved petition was filed.

Time Frame

I looked up the California Service Centre dates and it says that they are processing June 2004 for I-485. The link to that web-site

https://egov.immigration.gov/cris/jsps/officeProcesstimes.jsp?selectedOffice=63

Does this mean that CSC is proccesing cases that were transferred in June 2004 ?

My case was transferred o November 18th 2004. My I485 filing date was July 18th 2003.

Do I ave to wait for 5 months for the interview ?

Please help.

read this read carefully, USGC485 already listed the documents that they usually ask for. Plus your interview notice should also provide you with the list.

I-485 Interview done and case approved.

Hello All,

I would like to share my wonderful experience at the Sacramento office. I had my I-485 Adjustment of Status interview on the 22nd of this month at 1:00 P. M.

I had spent 10 fulls days putting all my papers together. The papers were very well organized.

I could have come in at 12:45 P. M. but I decided to play it safe and hence reached the INS office at 12:00 Noon. I was promptly called in at 1:00 P. M. by the immigration officer.

The officer was very kind and courteous and gave a very patient hearing to my daughter that is 5 years old!!! The 3rd minute that we were in, the officer looked up and asked me for my daughter's birth certificate (she was born here in Sacramento). I had only the original. The officer walked out with the original, made a copy, came back and said HE WAS APPROVING THE CASE.

Our passports were stamped and my wife and I were fingerprinted. The officer turned, looked at us and said 'Congratulations and Welcome to the United States'. 'You are permanent Residents now'.

We were approved in 7 minutes..............
