I-485

Hello
I recently got divorced and had I-485 pending with my ex. when checked the status, it shows they are processing it. Is still my 485 valid. How long INS takes to cancel the 485. Actually I need to renew my EAD, thinking should I go ahead to renew it or not, in case if it is not legal...

--- who is the primary? are you dervative?LC, I-140 was filed for you or your spouse?
If you are spouse and no I-140 was filed for you and you filed I-485 as dependent then you dont qualyfy for I-485 becase legaly you are no more spouse after divorce. I think the principal applicant has not updated the USCIS that is the reason it is showing i-485 being processed. If promary does NOT update the USCIS and by mistake I-485 gets approved it is fraud and primary applicant will aslo face problems.
 
I am not the primary applicant, have I-140, I-485 both filed at the same time and fingerprinting is done recently. is it still valid and not legal to renew EAD

Whose I-140 is that? Is that your? Or is that your hunbands?
If you have your own I-140, you should apply for your I-485 ASAP.
Your existing EAD card is not going to work out for you anymore. You need to re-apply EAD/AP alongwith your new I-485.

---it seems you are spouse of primary applicant and NO LC was filed for YOU and no I-140 was filed for YOU by any employer and you filed your derivative I-485 based on your spouse I-140 and now you got divorce, if that is true you dont qualify for EAD AP or I-485 based on your spouse Case. They day you or he took divorce your all pending application based on Primay applican will be denied as you dont qualify for that any more.

----- If you were derivative, your status ended on the day you took divorce and all pending petitions will be denied even if FP is done. you have no status to stay leggaly in US.
** if you have your H1 or I-140 was filed for you by employer and then you filed I-485 then only you can file for EAD, AP till I-485 is not approved or denied
 
Hi, this is the same person. I have received second finger printing notice from the INS although I have divorced my ex for more than a year back and he was the primary applicant. Should I go ahead with finger printing, is it legal. I do know all the pending issues with green card stops after divorce. What should I do, thanks for all the advice
