My I-485 is pending after getting my I-140 approved under EB1 with my employer based lawyer. I am not very happy with my employer and want to switch.

Since EB-1 does not require LC, am I still required to fill AC-21 etc. inshort.....

1) Can I move or am I obliged to stay with my present employer.
2) Do I need to keep working in the same line of work even though I did not have a labor certification?
3) Can you please comment on any differences between EB1 and EB2 processing on I-485.....are they both treated the same

Thx

1. 485 applies to all EB applicants. So you can move.

2. Yes . Same or similar job for which I140 was approved. See your i140 approval letter. Find the job code in ONET directory or SOC directory to find similar jobs.

3. They are treated differently (per normal processing procedures)

Thx Jaxen:

>>>>>Can you please elaborate on any differences in procedure. Do I still need to file AC21 after 6 mos.........and stay with my present employer for 6 mos after getting GC. I thought the whole point of "Outstanding Researcher" was that I would not be tied to a particular employer.

3. They are treated differently (per normal processing procedures)

>>>>>Can you comment on processing times and RFE for EB1 vs EB2.

E.g. My receipt date is April 2002 for my I-485, California date is 11/19/01.........When can you estimate will I get my case adjudicated.......Is the 11/19/01 the back of the pack or the front of the pack.

Thx

How are EB1 & Eb2 Treated differently

Hi Jaxen:

How are Eb1 & EB2 treated differently in I-485 Processing.

I was under the impression that all categories are on the plane once they reach 485 stage.

How you please throw some information on the same
