I-485 Issue with 1099 Misc

My spouse is sponsoring me.

I had a website in 2008 for which I just received a 1099 Misc from Google.

I talked to my lawyer and she says its up to the interviewing officer to decide what he wants to do. I know that for family-based , unauthorized employment doesn't make a difference so should I list this on my G-325 or just keep quiet about it till the interviewing officer asks a question?

What are my options here? I am not even sure if this is employment, so should I even mention it on my G-325? If I don't, would it be considered lying?

It's not. The INA prohibits the officer from denying the I-485 on this basis.

What are my options here? I am not even sure if this is employment, so should I even mention it on my G-325? If I don't, would it be considered lying?

I'm not sure it's really employment, or if it's passive income.

Were you inside the US at the time you were making money from that web site, and if yes what was your immigration status at the time?
