I-485 from India

1)Can we apply for I-485 for myself (H-1 holder with 2yrs.in US)as well as for family from India (in other words is the presence mandatory in US for the persons filing 485) and opt for CP processing as my Company wants to send me back to India for unpaid vacation?
2)What is the maximum duration one can take unpaid vacation in a given year and are there any adverse affects of it in GC processing whether here or CP processing?
3)Also what is the final stage to opt for CP processing, is it at the time of I-140 or I-485 or one can even opt for it at a later stage by submitting some form or some late fee?

1. 485 is AOS. So at least at the time of application you should be here in US. I think you can change to CP later.

2. unpaid vacation Might have adverse impact on CP

3. Better opt for CP at I140 stage. However you can also opt for CP after I140 approval. For conversion of I485 to CP consult an attorney as it is a trapeze act.
