I-485 for me and for members of my family, Is it one case or different cases?

I have three members in my family; we want to file our I-485 along with I-765 and I-131. My question is whether I should bind the application packages for each individual member separately, or all of them can be bound in one package.

USCIS says that "If you are sending more than one case in an envelope, clearly separate the cases by rubber band or clip fasteners." My understanding here is that, I-485 will be one case, I-765 another case and I-131 another case for one applicant. I doubt whether it means that all documents for Kibanga is one case, documents of Kibanga's wife another case, and Kibanga's fisrt child another case etc.

Need help on understanding this.

---make the separately for each member Primary application at top of package and on primary application package TOP page write I-485, Form I-31 fof Primary applicant on dependents packages write I-485 for depenent . better separate the cases by clip fasteners and send in SAME emvelope, out side the envelope write clearly : form I-485, Form I-765, form I-31 for Primary and dependents. Make the fee check seperrate for each application ( it means 3 checks for each family members and top of each application)

Thanks for your advice.

Suppose I send a separate check for each case for each person, i.e., for my cases, send a check for I-131, another check for I-765, and another Check for I-485; then do the same for each member of my family, i.e. send a total of 9 checks. Is that OK?

One more question: My I-140 approval notice states that I should consult my local USCIS office to get instructions on filing I-485. What should I expect from this local office, it it possible to do the fingerprinting at this local USCIS office before filing the I-485?.

--nothing, wastage of your time, file the I-485,EAD, AP with service center

Ginnu, can you do me some additional favor on this one?

The process of filing my I-485 is delayed by the medical exam especially since there are no civil surgeons in my area and I have to travel to the next city, which is about 3 to 4 hours from my city. My job requirement has only one day per week that I can be away, and that has been very hard for me to synchronise with the available times by the civil surgeons. I want to submit this I-485 as soon as possible especially since I plan to change jobs before end of the year and use AC21.

Now is it possible to submit the I-495 without I-693 for now, and probably send the I-693 during fingerprinting? What could be the repercussion for doing this way.

----- you can send and will get RFE for medicals, I prefer to send with all documents
What could be the repercussion for doing this way.
----- RFE for medicals, better attach the medicals now with I-485 files, if you send later with out RFE then medicals may not be attached with I-485 file.

Thanks Ginnu, I will definitely make sure that I have all my papers together.
I have been able to get an appointment with the Civil Surgeon next week.

Dear Ginnu, help me on this please; I trust your advise.

As I was packing my documents ready for submission of I-485 package I discovered something that has frightened me to death, it is like this.

(1) My first passport was to expire on May 05th, 1998 extendable for another 5 years to 2003. I submitted it to my embassy for extension in April but it was stamped on June 18, 1998 that it has been extended to May 04th, 2003. The fact that it was stamped after it has expired worries me that it can be interpreted that there is a period that I was out of status.

(2) This passport eventually expired on May 04th, 2003 and hence I needed a new one. However, at that time my embassy told me that they had no new passport books. The new Passport was issued on July 10th, 2003 and it states that it is valid from that date. Now since my old one expired on May 04th, it means that during the period from May 05th to July 9th I was without a valid passport. Can this be a serious problem?

This is scaring me to death, what should I do?

I sincerely need an advice on this.

--No problem, just attach the copies of valid passport with your I-485

Your respose gives me some breath, but there an advise that if one got a new passport while in this country, then copies of both the new passport and the old passport must be attached- this will show a discontinuity in the validity of my passports.

Additionally, the USCIS advises to send all documents that can show that you have never been out of status, that includes all copies of past I-94 since first entry. In that case, I have to include information that ranges about 8 years back, including my old passport.

There is an information at Ohio State showing that among other things I need to include:


(a) Copy of all passports held while in US.
(b) Evidence of having maintained uninterrupted non-immigrant status.
(c) Form I-864 as affidavit of support for members of my family.
(d) Copy of my transcripts (since initially I was on F-1).

Similarly, an information at Cornell shows that I need to show copies of all documents to support my non-immigrant status since entry as in (a) and (b) above. Will that gap in my passports as I have stated in my earlier posting cause a problem?. Do you think that a letter from my Embassy stating that theye were responsible for delaying my passport can help?.

As an added difficulty, is it true that I need to fill Form I-864 for members of my family? I think that I-864 is filled by permanet residents and citizens of the US; and I am none of them yet, why should I do that?

My transcipts also have problems, one semester was not recorded since my tuition was not received in time, and that was way back seven years ago. Is it OK to attach a letter from the registrar stating the reason for not recording my grades fro that semester?

Elsewhere, I don't remember, they have indicated that I need to include copies of my pay stubs, and tax returns for that last two or three years. Do I reaaly need to do that? and why? Is that also in effort to verify my past status?

I really need serious help now. Things are getting hot at this last minute, and I dont want to risk any silly mistake.

------ education degree or EXP certificates are attached with Lc or at the time of filing I-140, they are NOT need to be filed with form I-485. did you read the instructions with form I-485???

Your responses are just like what I believed; these information documents at Ohio State, Cornell and perhaps Oregon State or Washington State were just confusing me. I noted that they are not consistent; each one has additional stuff that are not listed by the other and not even required by USCIS.

I belive my current package will just go just as it is, I will not include transcripts, or even my expired passports. However, I include my alll copies my old I-94 and any other document that I received from USCIS.

The only question that I can ask if you won't mind, is on how to verify that I was paid according to LC on H1; in fact I was paid higher than that. Should I send copies of my tax returns along in my packages as some have suggested?. I have copies of all my returns for the past 7 years.

In the meantime, let me work on I-134 to see what it is about and then proceed from there.

--- why you need to include ALL I-94? do you want to confuse the officer? just send the Copy of Valid recent I-94 (front and back)
