I-485 Denied due to Abscence on Interview - Please Help with your Advice

Hello Friend,

Please help me with your advice on I-485 as my application was denied due to absence at the interview time as USCIS office is telling they send the interview notice on october . Truth is that I have't received the interview letter and after 6 months they send a notice that my aplication was denied and when i enquire with them they are telling that they send the letter to the address and it was never returned back to them as undelivered. so they though that it was delivered to me. But i am living in the same address as before. Same case for my ead when there notice was returned to them but got back the card after calling the helpdesk. same thing for I-485.
Please help me with ur advice what to do in that situation. In the denial letter they told that my EAD will expire due to denial of I-485 within 15 days even though it is valid till November 2007. Please help me what to do to solve this.

I have contacted an attorney and is doing motion to reopen by paying $385.
Please advice me if motion to reopen is a good thing to do in this situation and do i need to refile I-765 again to get work authorization.

Thank you very much for the reply. i have send the motion to reopen with filing fee $385 today. I heard from forums that there is a chance of motion of reopen getting rejected. In that case do in am in danger of getting deported. is there any other options to live here. do in need to reapply I-485 and I-765 again. How can i know that motion of reopen is accepted. whether USCIS will send any letter regarding that. How long will it take to know about the status of approval. because as per the denial letter i need to leave US in a month.

Please provide me your valuable sugesstions.
 
Hang in there! I can emphatize with you, though I filed my MTR last Jan 19, 2007, got no reply yet (my lawyer even sent another follow-up letter) NO response from the DO still. Nothing we can do but to wait and pray! Anyone knows how many months to wait for MTR result?
 
I-485 denied

Is my EAD will again become active after i filed for I-485 motion for reopen or do i need to apply I-765 again to get work authorization. My ead is valid till Nov 2007.

Last september my cousin who had just moved in from conneticut to Florida had got an info pass to get his passport stamped, he needed to make sure his file was transfred and needed an extension on his first green card because he hadn't received the appointment letter for the second interview yet. Not only he didn't get his passport stamped but he got arrested and was in jail for 30 days until we finally were able to get him out. Apparently, an interview letter was sent to his old address ( he never received it), of course he didn't show for the interview so his file was transfered to the immigration court. He never showed up for his court date ( guess why?), so the judge ordered him to be deported and put a warrant on him. 5 MTR later and a lot of $$$$ we were able to get him out of jail, the officers took everything away from him before letting him out: liscence, passsport. He was told he wasn't to drive or work until his case was closed.
Thankfully he's fine now, all in all it took about 4 months ( felt like 40 years). He didn't have to re-apply for anything they just gave him his stuff back.
