Citizenship and Family Cases : Centralized Processing Likely
The Missouri Service Center (MSC) will likely be the sole location for filing
citizenship and certain family-based applications. The Acting Director of
MSC released this information in late January 2003. The changes are
expected in June 2003 and will be phased in gradually, starting with
applicants living in the Northwestern U.S. Those filing these types of cases
in the future should be mindful of the anticipated change.
It should be noted that the term “family based” refers to those cases which
are based on the petition of a relative. This term does not refer to the
benefits given to family members of beneficiaries of petitions filed through
an employer. For example, if a U.S. citizen wife petitions for her husband,
the case is family based. If a company obtains a labor certification for an
individual, and that individual, as well as his or her spouse and minor
child/ren, are able to request green cards, the case for each person is
considered “employment based,” according to the INS.
The planned change will make the MSC responsible for processing
citizenship applications and family-based adjustment of status applications.
The MSC will not issue decisions in these matters. That responsibility will
rest with the INS local District offices. The District offices conduct sworn,
in-person interviews in most cases of this nature. The role of the MSC will
be to process the fees, perform IBIS background checks, schedule
fingerprints, and collect biometric data. They then will transfer the file to the
appropriate INS district office for interviews.
In family-based cases with the adjustment of status and the relative petition
filed together, the MSC will process both the relative petition and the
adjustment of status application. The concurrent filing procedure is only
available for those cases considered in the category of "immediate
relatives" (spouse, parent, or minor child of a U.S. citizen). For these cases
of "immediate relatives," there is no waiting time for the priority date to
become current. MSC will be able to issue the Employment Authorization
Document (EAD) and Advance Parole (AP) filed in conjunction with these
cases.
