Good day! Please has anybody filed concurrent I-140/I485 without the company financial documents? My labor was approved this April and I am now applying for the green card thru future employer and it seems the sponsor (private firm with 20 employees) is feeling reluctant to give out his financial documents. I am desperate. is there any possible way out? Please reply.
 
Ginnu you must have misunderstood my previous thread. I asked that question to NYB who received his or her RFE and after he got approved. If you read the thread again and well, you will understand that I just copied the NYB thread and I asked him a question under the thread. I was just wondering the type of documents he sent. Try to read well before accusing me for nothing. Thanks. I am just desperate since 'am still unable to get the company financial docs to file my I140/I485. Your help is still appreciated if you can.
 
From my knowledge, you can file I-140/I-485 without the company financial docs, but you'd better talk your bosses into releasing that in the near future, because BCIS will certainly ask RFE with those specifications.

Nope I-140 petition can not be filed without sponsering employers financials. On the I-140 form itself there is a condition that sponsering employer must have and prove the 'ABILITY TO PAY' the beneficiary employee from the date of the application for labor certificate. Unless the sponsering employer has employee stength of >500 US employees, financial statements and/or tax returns are must. If sponsering employer has employee stength of >500 US employees then a statement of this effect from CFO of the employer company will suffice in palce of financial statements and/or tax returns.
