I-140 Time in CA

Don't believe 270-300 days. Not intend to discourage. My one was very luck as far as I think and took 332 days!

can someONE PLEASE TELL ME
FOR CASES FILED IN AUGUST, when will they be approved?

can i add 485 processing to the i-140 as well using the i-140 receipt notice. i am about to fire my totally incompetent lawyer and get a new aggressive lawyer and they will handle the case from there on.

1. No idea
2. with the I-140 receipt notice you can file I-485. Its treated as Concurrent filing.

Does somebody know what that "hell" dancing of dates may mean?

That means now the system is pretty configurable. I'm afraid that the message would be changed to "300 to 330days" in next month. :D

Now the system says "It is taking between 360 and 360 days for us to process this kind of case."

OK. I just wait for that :-(

The memo, HQBCIS 70/6.2.8 – P (I140_AC21_8403.pdf), addresses the following
A. Approved Form I-140 Visa Petitions and Form I-485 Applications
B. Provisions in Cases of Revocation of the Approved Form I-140
C. Validity after Revocation or Withdrawal
but it did not exemplify whether the change of job or employer is allowed while Form I-140 is pending and Form I-485 has been pending 180 days or longer

There has been perpetual delay by Service Centers in processing Employment Based (EB) Form I-140 processing. Because of this delay and while Form I-140 is pending and Form I-485 has been pending 180 days or longer, if the employer closes the company or if the employee gets laid off, the entire Permanent Residence processing has to be abandoned and the employee has to start from the scratch and once again spending years of time and so much money.

So I humbly request USCIS to fathom the permanent residence aspirants' above-mentioned problem.

The above-mentioned problem shall be alleviated, If there is a provision to allow the beneficiary of the Form I-140 to change jobs or employers if the new job is in the same or a similar occupational classification as the job for which the petition was filed and Form I-140 remained unadjudicated and Form I-485 has been pending 180 days or longer. This gives some relief for the beneficiary of the Form I-140 and he/she can continue the permanent residence processing without abandoning it and with no threat from the employer through which the immigration petition Form I-140 was filed.

i-140 DELAYED AGAIN

the latest processign times of i-140 are now back to may 2003.
every month they are going backwards two months.

seems like this is intentional and they want to extract maximum pain and torture us till we just give up and go home.

even guantanamo bay prisoners have more rights

this whole thing is such a joke. they keep changing policies every day. there is no time frame for any stage. there is no reason whatsoever why the dates are going back

this is just ridiculous...worst thing is if the company closes or if the employee gets laid off after going through this process for 4 or more frikkin years he/she has to start it all over!!!!!!!!!

if they don't want to give they should just say that

or maybe its better to apply as illegal immigrants

01/14/2004: USCIS Plan for I-140 Processing Delays and Backlog Reduction

As the readers know, the I-140 processing is currently heavily delayed in all the Service Centers. According to the USCIS sources, USCIS plans to move the resouces within the Service Centers that are tied up with the H-1B cap cases to the I-140 production unit as soon as the H-1B cap reaches. There is no information available about exactly when the cap is expected to reach, but it is everyone's guess at this time that it may not be too long away. Please stay tuned.

I am sure USCIS has the ingenuity of coming up with a new reason for delay once the capped is reached. so don't hope. but do we have a choice ???
 
I've just checked VSC processing date and found they are doing good job, well, only for I-140C category:-(

Anyway, USCIS is working. Just be patient!

Just checked the H-1b Forum and here is the latest update of the H-1b cap

H1B cap update from USCIS
Here is the official news regarding the cap:

It seems 43,500 cap subject cases have been accounted for. This includes both approved cases as well as pending cases, but they do not specify the split between the two. This includes backlog from previous year. AILA earlier reported that 11000 cap cases were pending from previous year. So it looks like about 10000 cases per month are being filled. That means that one could file new H1B petitions for another two months. So, there you go, end of March! Things could slow down, once the premium processing is stopped. So maybe a little longer.
 
Guys,
I-140 will take 8-12 months in CA center bcos they are focusing on 485 application. we r very unlucky that its come to our application only at this time, otherwise it takes 3-4 months.
So be patient.

What happens next for CP guys?

I understood that CSC is spending a lot of time to process I-140 applications.

What happens next for those people who choose CP?

Scenario A:
Since there are quite few backlog of CP, we will see CP day shortly after approval of I-140.

Scenario B:
CP is independent process from I140, so it still takes few months or almost a year after the approval of I-140.

I've been waiting for my I140 for more than 10 months while I'm staying in US with L1 visa, which will be expired this October. This is my seventh season of L1 status so I can't extend it any more.

Do I have to leave US if I can't have CP before my L1 visa expires??

BTW I choose CP because I often trip to out of USA. Adjustment of status is not my option.

I-140 (EB-2 NIW) approved on 01/28/04 RD: 07/03/03 (notified by mail) no RFE, self petition (without attorney)

EAD approved on 01/28/04 (on line system confirms)
AP still waiting

On line system does not show any change for I-140... it is still "from 360 to 360 days"...

I'm now in I-485 pot...

Your AP is still pending, but did you see any change to the online status? Online status of my EAD says it is approved, but my online status for AP says:"On xx, 2004, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued."

Not sure if your AP pending assessment is based on this kind of message or something else?

EAD was approved and this was confirmed by on line system.
For AP there isn't any change in the original message ..."it takes between ... days to process this kind of case"...

I hope that will be changed in next few days.
