I-140 message updated to 270-300 days

I just checked my I-140 message and it now says it is taking between 270-300 days and the I-485 message says 660 days. Atleast a couple of months have been shaved off. Should we expect such improvements going forward ?

Okay so i noticed that i-140 timeline change to 270 and 300 days from 365-450 days.... wondering if they are actually processing cases or teasing us ?

hoping for the best!
 
definitely teasing us. I have been waiting since august 8, 2003. so, 300 days has already passed. Its wierd that their JIT says working on 7/18/2003 and online status stays 270-300 days.

I applied to I140/485 recently and I got the RD for my I140 today. My lawyer said that the time that USCIS mentions is national average and nothing to do with any specific center. So I believe the change may not be related to our cases...
Just my 2 cents. :)
 
My I140 message also got updated to 270 -300 days from 365 - 450 days .

The dates don't give us any reasons to celebrate. It's not over until it's over!
In one of my earlier posts, I mentioned that I had filed my I-140 more than 400 days ago and replied to the RFE 60 days ago.
Does anyone here know about any or all of the following?
a) if someone's I-140 has taken 15-18 months or worse?
b) Has anyone here had more than 1 RFE for I-140?
c) Known or heard of anyone who has filed his/her employment based Green card without the help of a lawyer?

I've heard of a case where I-485 for someone took > 4 years. This person's file was lost and he had to go through 5 EADs, 4 fingerprints and a lot of hardship and pain thanks to the ineptitude of the lawyer.

one of my friend applied 140 in AUG 2002, 2 RFE's issued, replied it, Last RFE replied last year Feb.2003, still he didnt hear anything from USCIS.
Lawyer, faxed a message last month back asking what happen to the case, still, USCIS didn't responded it.
Also 140 in California getting more grilled than any other service center, denials also coming, only 485 moving fast without less pain bcos they want to reduce 485 backlog first.
So dont know what will happen to our case, also in last 4 months CA service center approved around 60-70 cases only.
its unluck for we, 140 peoples who stucked in this time frame in CA center.

LUD change?

I was checking my last updated date (LUD) on BCIS status portfolio and I noticed my 140 LUD is 4/14/04, my RD/ND is 8/8/03. No activity, no RFE..nothing...

Any of you see this kind of date change?

btw, mine is EB2
 
I think the 270-300 days is bad for old filers

Seems to be that INS plays the trick of avarage process time game, they process some case in front (I-140/485 concurrent) and leave many old 2003 cases on behind. They average all cases to get 270-300 days (9-10 month), and probably by september 2004, the number will be reduced to 240 days which is 8 months. This is the goal they set for I-140. However, the reduction of average processing time does not do any benefit to old filer since we are continuing suffering. What a damm!
 
Hi goodluck and rb180....it's sad to see that you have been put through such an ordeal. Hope your law firm and company will stand strong by your side.
I suppose it is a long wait for I-140 approval, but it is good news if I-485 is moving.

BTW I managed to get my 2nd EAD approval within less than 2 months. The upper and lower limit was 120 days, but it got approved in less than 60 days. I was surprised because they say that normally if u get RFE for I-140 it holds up EAD, Parole etc.
EAD is just for backup, im still using H1 to work.
I hope it is a multiple year EAD (not got it in my hand yet)
 
Congrats for getting 2nd EAD. What do you mean by multiple year EAD? Is it possible to get one like that? I heard that EAD is valid for only one year.

I haven't applied for I-485. I will be doing it this week or next week. Then it will be a very long journey.

At what point of time our H1b is invalidated? Is it when you use your EAD or AP? Or even when we apply for a EAD? I am little confused. Its a good idea to work on H1B.
 
goodluck, i forgot to say congrats to u for finally getting the I-140. Phew!
There was a new rule in the works for 2 year EADs but i guess it wont apply to me when i read this rule again on www.immigration-law.com
Read the section:

06/04/2004: OMB Cleared Rule to Authorize EAD for 2-Year Pending I-485 Applications

Hope u have your necessary documents ready for I-485. H1B gets invalidated if you don't use it/renew it and start working on EAD. Remember H1B = Non-immigrant visa and EAD = Immigrant petition work authorization.
I suppose if you use AP to enter the country H1B status can be in jeopardy. (Check with the lawyer).
To be on the safe side work on H1B, but apply for EAD and Parole just in case u have to forcibly change jobs. Better to have 'em and not need 'em than to need 'em and not have 'em..

Yes mine is EB2. I filed in CA INS. My lawyer filed concurrently on 25th of June. She said they sent both I140/485 in same packet so that it is concurrent.
She got a receipt around 6/7 of Jul for I140 and am still waiting for 485 receipt with RD for I140 as 28th June.
I am kind of worried as I did not receive the receipt for I485. I only fear that CSC will mark a different date for 485 RD.
How about you guys? Do you guys get the receipts for 140 and 485 the same day????

My I-140 has been filed in 6/2002 and still not approved. I got 2 RFEs one replied in 12/2002 and one replied in 7/2003. Now the status says its taking 270-300 days!!
Dont know whats happening. One reason for the delay might be this- my company got acquired in 9/2003 and the bigger company is continuing my GC process. I got my EAD/AP recently though.
Any advice on my case is greatly appreciated

The company takeover must be the reason for your delay, I guess you/your lawyer must have sent the details about the new company.
You didn't mention about when u applied for I-485, if you applied for I-140 in 6/2002, you might have qualified for concurrent/semi-concurrent processing.
I-485 processing date is June 2002 for CA. Did u do your Fingerprints?
You'd better act soon through your lawyer to ask him/her to launch an inquiry. Hell, it's now time when you are supposed to get your I-485 case opened!

A general question here: Has anyone heard about I-140 cases being approved in CA lately? Any success/fluke stories?
 
I-140 files in oct 2003 still waiting

just curious if some one has answer to this.

filed 140/485 in oct 2003. got EAD/AP in jan 2004. my wife got job in Mar 2003. me and my wife are now using EAD and my H1 has already expired.

If for some reason i loose my job before getting 140 approval

1. can my wife still continue working ?
2. can we apply for new EAD after the current EAD expires ?
3. what will be my situation in this case

any ideas ?
